    Way to go Spikey!

Yeah, where and when is this HHS committee meeting? I'm not suggesting we protest (although that's not a terrible idea), but I for one would like to come and show my support, even if I don't speak. Would that be a good idea for others within travel distance of L.I.?

I have been wondering about the whole "are we still 'smokers'" question for awhile. If it poses genuine legal difficulties, then we should unilaterally declare ourselves not to be smokers or users of electronic cigarettes. Name recognition aside, we want our rights--especially our right to vape. We can still call them 'fake cigarettes', anyway :-).

Also, I'm not a lawyer, but if you have access to one, you might want to have him/her take a look at Section 9 (SEQRA Determination) of the proposed legislation. The effect of a new law on the business community and requiring people to be and not be in certain areas while using a legally-sold product might be considered a Type I action under SEQRA. It might not make much of a difference, but that would mean an Environmental Impact Statement must be drafted and a public comment period announced.

    Well done folks!

I'm glad to see that you mentioned the fact that banning use in non-smoking areas makes them cigarettes in the public's minds. It is unfair for a non-scientific board to make a scientific classification, especially with no research to back it up (lack of proof for A does not equal proof for !A). I think it's best to be honest with these people and recognize that there *could* be a risk, but that it's not the same risk as cigarettes.
Most of the second-hand smoke from a cigarette comes from the burning end, not the lungs of the smoker. That burning end doesn't exist with the PV. The second-hand vapor that DOES exist comes out of the user's mouth/lungs is quickly dissipated, but could still be inhaled by a nearby person. Someone could be allergic to the PEG vapor. (I'm allergic to most perfumes. Giving off strong perfume vapors is acceptable in public.)
The real potential harm is in the nicotine that remains in the exhaled vapor. From everything I've read and everyone I've talked to (including pharmacists), nicotine itself is not that harmful. It has numerous positive and neutral effects (increased focus, appetite suppression, etc.). The problem is the addictive factor. So, couldn't someone potentially become addicted to nicotine by being exposed to it from our exhaled vapor in small public places?
According to the New Zealand study, 98% of the nicotine in the vapor is absorbed by the user. The remaining 2% is quickly dispersed, leaving a passerby the potential to inhale somewhere between 0-2% of the original nicotine produced by the PV. I would argue that that's no risk.

Sorry for the long, ranty post. That's been a-brewing and I had to get it out.
