It's alright though I still have the old domain name forwarding to the new domain. Double the keywords now. And nothing he can do about it. Not to mention a few hundred members that where not to happy about is actions, and thats quite a bit in the small ecig market. What a great marketing move!

Viper no offence but I wouldn't be surprised if you where Esmoke as well as he likes to use numerous names. Why would this effect you? The reason I had to change my site name was because my domain used to be esmoketalk.com the term Esmoke was trademarked by Esmoke.net Now granted I didn't HAVE to change my name in fact my lawyer stated that as long as I wasn't selling anything there really isn't any reason why I couldn't use the name. (There is of course much more to this however not anything that I'm willing to talk about on the forum) If I decided to open a store, wether part of the forum or not, I could run into legal issues down the line. So rather than deal with BS later on we decided to change the name. The site was also (and still is) very young. Better it be done now than later. Plus we should to call them ecigs and we're starting to call them vaporizers and refer to the vapor as vapor rather than smoke. So Vapor Talk actually works better. As for the legal action, this was sent via a PM and again I would rather not discuss the details.

There is no offense taken rather I thank you very much for taking the time to answer. I was under the impression that one had to receive a certified letter from a trademark holder with proof of the trademark. Thank you again for sharing that even though it was from a PM. I sincerely appreciate the information. I wasn't planning on creating a forum. After all, I am now trying e-cigs or as you say, PVs, to hopefully add years to my life, not take them off! So far I'm not convinced that selling them would help either! This confirms my conclusion a bit more. My interest is to sell them at a local flea-market where I sell other items, but that seems like it is not a good idea. I am very afraid of the risks associated with buying directly from China where the prices would almost make it worthwhile but only if I bought enough at one time. The items I generally sell are not more than fifteen or twenty dollars and I don't see how it would be profitable selling PVs, as you say, at even ten dollars more than that. Even if I could, I would have to sell them with no guarantees. I would surely lose money if I offered to exchange them, which I normally do with the items I sell, should my customers have a problem. I buy items from a catalog company and they have been very good about returns. That is very important to me. What intrigues me is the wow factor when folks see this in person and the flea market is great for that. I think now the risk factors are too great and I would just refer them to where I got mine. Anyway, I appreciate your kind response. Obviously, you did not have to volunteer the information but I'm so glad that you did. |

Hi Debbie and welcome to the forums by the way They didn't sent me a certified letter but they did send me a link to the USPTO and they do indeed have a trademark. It just wasn't worth the potentially long term BS. And if you wanted to sell at the flee market, shoot do it girl! Just use the generic term "ecig" and your goot to go. As for China there is a risk, but there is a risk in any biz you start. They're actually quite helpful over in Little China

I do agree that any business startup is risky but although I can get behind the mission, to me, it looks like the big dogs in this business and the kiosk types (and I would think the fleas market folks would also be) the low hanging fruit for big problems from the authorities. My flea-market business is really 100% fun. I'm outdoors all day in the lovely weather where a lot of local folks and even folks from out of town come around and it's just very pleasant and relaxed. I don't have to answer complicated questions or give technical explanations to anyone, least of all the cops or FDA. I'm thinking that I'll just smoke right there outside, along with everyone else smoking regular cigarettes and if they ask me I'll give them my card and write the affiliate link on the back to the website where I buy my stuff. I went as far as to sign up cause it was actually pretty easy to do. I admit that I check the site to see if it's still there every now and then. That's more than I would if I just needed to go there to order some cartridges. I actually got my first commission from myself on a cartridge order. 80 cents! Well it's a start! I'm not counting on making any substantial money in this business or putting in any major commitment because it just seems too risky, stressful and complicated right now and for me, "business" is about the people and fun and not an agenda, mission or even the money for that matter. I just feel good knowing that some dad will be appreciated on Father's Day, and I look forward to good weather weekends before it comes up next month. For me, it's really about the kid who got a hundred on his spelling test or her graduation and leaves it to collect dust on their desks or a grandma on her birthday who puts it on her coffee table. It won't break, it's cute and fuzzy or can even be a little home for plants or little pets. Kids can play with them all they want. I'm going to stick to that for now.
