So different people will claim different things and get away with it.

I think that for IVA to be effective the sale of the goods has to take place in the confines of the country. Hence this is a territorial requirement.

They could have included the VAT within the price, then you would not have the question. The reason why VAT is there is when you are a business and need the flavorings and the other items they sell to run your business, you can deduct that from your profit made (income_tax), that is the way it works in Europe. even when you include the tax, the prices are good, at least when your salary is paid in Euro's. the US Dollar is not so strong anymore and therefore it is quite expense for US-Citizens.

No...you miss the point.
This is a legal issue not open to interpretation.
Second point, I don't know too many European customers or consumers that know the response to this, since they live inside EU.

Since Flavor Art does not want this hassle, they charge a 20% VAT.

It would have been better if on their website they had just given us a price.
The problem is that they have to include VAT for customers within the EU.
Ideally they would have a USA site tax free and and a EU site with VAT.
I do realize this is a major complication though.

Having said this, their site clearly states that they have to charge VAT.

Answer = yes if they sell within the EU borders ...
And No if for direct export.

Yes come Monday morning, they will be questioned. From all sides.
Something is not right here.
Of course I can well understand the flare and appeal of having a "Made in Italia" label on the bottle.

As the old Italian adage will quickly prove itself...."The devil makes pots and pans....but he does not make the covers for these!!"

And the shipping address wouldn't suffice for proof of export? It is with almost every seller in the EU that I've dealt with. Something is hinky!

I just spoke to the owner or general manager of flavor art in Italy.
We had a lengthy conversation regarding the flavors, their commitment to excellence, and the VAT.

Their company is 100% legit. I am very impressed, by their expertise and web set up.
I have ordered some flavors, and am sure they are top notch.

As for the VAT, they need to prove to the Italian authorities that the receiver has a Federal Tax ID in order to deduct VAT in Italy.

Since most orders are small and go through regular mail, VAT has to be charged to the end consumer.

This is to attest, that any suspicions on my behalf regarding this company were unfounded.
I look forward to receiving these new liquids.
