			<content:encoded><![CDATA[<div>IMO, when talking about allowing SECOND-HAND vaping, we should NOT be comparing e-cigs to combustibles, because even if our vapor is 1/10 as harmful as smoke (It is NOT!!!!) that will not be perceived as a reason not to ban vaping in  public.<br />
<br />
My feeling from 2 years of college chemistry is that if you heat up something made entirely of ingredients OK in food, the worst you can get should be comparable or milder than restaurant or kitchen air, unless the restaurant only serves cold foods, and CERTAINLY if the restaurant uses frying, grilling, etc., i.e. higher-than-boiling-temperature cooking methods.  (Yes, our eliquids get processed above boiling but not much from what I've read.  Like 300+ degrees, compared to significantly higher for frying, baking, broiling, etc.<br />

So a reporter asked me Thursday for  comparisons to what is in restaurant air.  I found some information about metal contamination from utensils, and the dangers of french fries, but I'd prefer to find something numeric.<br />

I found this, which might be helpful.  Can others find things that we can maybe put side-by-side with the vaping studies for comparison?  I think that is needed for the &quot;second-hand-vaping&quot; fight.<br />

The search engines provide suggestions of other popular searches to click on ... and still no <acronym title="Consumer Advocates for Smoke-free Alternatives Association">CASAA</acronym>.org.  <br />
Some of the popular key searches are: <br />

On April 30th, the Senate Judiciary Committee moved SB 648 to the full Senate by a 4-1 vote (likely to be 5-2 after late votes are counted).  <acronym title="Consumer Advocates for Smoke-free Alternatives Association">CASAA</acronym> would like to thank the 50+ vapers, retailers, and manufacturers who attended and spoke out in opposition to this bill.  <br />

<u>The fight to stop SB 648 is NOT over</u>! SB 648 is now awaiting a full vote in the Senate.  It is imperative that California citizens <a href="http://findyourrep.legislature.ca.gov/" target="_blank" rel="nofollow">contact their own California State Senator directly</a> and encourage a NO vote on SB 648.  In these communications, make sure to include your address and phone number. <br />
<br />
Please note that if SB 648 is approved by the Senate, the bill is still NOT law.  It must go through the committee process and a full vote in the California Assembly.  Vapers must remain vigilant against this legislation every step of the way.<br />

If enacted, this bill would: <br />

Ban the use of vapor products wherever smoking is banned. Among those provisions most likely to impact users are those that would:<br />
[list][*]Ban e-cigarette use in virtually all workplaces in California, including in hospitals. Violations would be punishable by fines of $100, $200, and $500. (Section 12)*[*]Ban e-cigarette use inside or within 20 feet of any public building or in a vehicle owned by the state. (Section 4) [*]Declares that the use of electronic cigarettes “may be a hazard to the health of the general public,” and would include e-cigarettes in all future smoking bans passed in California. (Section 11)**[*]Ban e-cigarette use in railroads and air carriers. (Section 13)[*]<s>Permit landlords to ban e-cigarette use in private homes. (Section 2)</s> (Removed from bill)<br />

<font size="1">* While it would appear that Senator Corbett's newly-amended version of SB 648 dated April 22, 2013, would permit e-cigarette use in hospitals, this is not true.  The sections referencing hospitals were removed from the bill because the provisions have been superseded by other laws. <br />

2. Tell your story on how switching to an e-cigarette has changed your life.<br />

3. Explain how smoking bans are enacted to protect the public from the harm of  secondhand smoke, but e-cigarettes have not been shown to cause harm to  bystanders. In fact, all evidence to date shows that the low health  risks associated with e-cigarettes is comparable to other smokeless  nicotine products. <br />
<br />
The low risks of e-cigarettes is supported by research done by Dr. Siegel  of Boston University, Dr. Eissenberg of Virginia Commonwealth, Dr Maciej L Goniewicz of the Roswell Park Cancer Institute, Dr.  Laugesen of Health New Zealand and by the fact that the <acronym title="Food and Drug Administration USA">FDA</acronym> testing, in  spite of its press statement, failed to find harmful levels of  carcinogens or toxic levels of any chemical in the vapor.<br />
<br />
At the April 17th meeting of the Health Committee, Senator Corbett cited a study finding trace levels of metals in e-cigarettes as a reason to support banning e-cigarettes in public places.  Please urge the legislators to read Dr. Michael Siegel's two articles on that study (<a href="http://tobaccoanalysis.blogspot.com/2013/04/metals-in-electronic-cigarette-vapor.html" target="_blank" rel="nofollow">here</a> and <a href="http://tobaccoanalysis.blogspot.com/2013/04/new-study-sounds-alarm-about-metals.html" target="_blank" rel="nofollow">here</a>).  <br />
<br />
4. Detail how electronic cigarette use is easy to distinguish from actual smoking. Although some e-cigarettes resemble real cigarettes, many do not. It is easy to tell when someone lights a cigarette, from the smell of smoke. E-cigarette vapor is practically odorless, and generally any detectable odor is not unpleasant and smells nothing like smoke. Additionally, e-cigarette users can decide whether to release any vapor (&quot;stealth vaping&quot;).  With so little evidence of use, enforcing indoor use bans on electronic cigarettes would be nearly impossible.<br />
<br />
5. If you are a California resident and currently vape in public, talk about your experience.  Do businesses you frequent allow you to vape?  What about your office? Be sure to include your address and full name.<br />
<br />
6. Inform them that the ability to use electronic cigarettes in public spaces will actually improve public health by inspiring other smokers to switch. Surveys of thousands of users indicate that the majority of those who switch, completely replace tobacco cigarettes with the electronic cigarettes, reducing their health risks by 98-99%.<br />
<br />
7. Explain that Senator Corbett misled the Health Committee on April 17th by claiming that she had never tried to ban the sale of e-cigarettes to adults.  In fact, Senator Corbett did try to ban the sale of e-cigarettes in California in 2009 with SB 400.  It was only after Governor Schwarzenegger <a href="http://www.leginfo.ca.gov/pub/09-10/bill/sen/sb_0351-0400/sb_400_cfa_20100113_103618_sen_floor.html" target="_blank" rel="nofollow">vetoed the bill</a> that Senator Corbett amended it to only ban sales to minors. <br />
<br />
8. Tell them that by switching to a smokeless product, you have greatly reduced your health risks.<br />

Why?  <acronym title="Consumer Advocates for Smoke-free Alternatives Association">CASAA</acronym> Science Director Dr. Carl Phillips took on this issue <a href="http://antithrlies.com/2013/04/25/who-leads-the-fight-against-banning-e-cigarette-sales-to-minors/" target="_blank" rel="nofollow">here</a> and <a href="http://antithrlies.com/2013/04/27/why-do-the-american-cancer-society-e-cigarettes/" target="_blank" rel="nofollow">here</a>, but it boils down to this -- the American Cancer Society doesn't just want e-cigarette sales banned to minors.  The American Cancer Society wants e-cigarettes to be taxed and treated just like cigarettes, and they are willing to stop a ban on sales of the product to minors if a bill doesn't set the stage for this to happen in the future. <br />

SB 1209 has already passed the Arizona Senate and gone through the House committee process. The final step before going to the Governor's desk is to pass the full House. <br />

<u>The below legislators need to hear from Arizona e-cigarette users who SUPPORT SB 1209</u>. <br />

1. Inform them you SUPPORT SB 1209 because it would wisely ban sales of &quot;vapor products&quot; to minors, but would NOT tax the product or define them as a &quot;tobacco product.&quot; <br />

If enacted, this bill would:<br />
[list][*]Tax sales of e-cigarette products containing nicotine (&quot;vapor products&quot;) at 5 cents per milliliter of liquid.[*]Require e-cigarette retailers who import nicotine-containing products from other states to obtain a license to sell tobacco products and abide by lengthy regulations.  [*]Make it a criminal offense for consumers to buy an untaxed e-cigarettes online unless they file a tax return with the South Carolina Department of Revenue by the 20th of each month. <br />
<br />
As recently exposed on the Daily Caller by Matthew Bandyk, bills like H. 4074 are a part of a concerted strategy by tobacco company R.J. Reynolds (RJR) to tax sales of electronic cigarettes.  RJR has its lobbyist(s) out everyday in South Carolina campaigning for this tax, so a swift and heavy response is needed from South Carolina vapers to stop this bill!<br />

1. Please vote NO on H 4074, which would hike taxes on tens of thousands of South Carolina e-cigarette users and treat e-cigarettes like a tobacco product by requiring tobacco licenses.  Alternatively, amend the bill to clarify that there shall be no excise tax on &quot;vapor products,&quot;  and remove all references to &quot;vapor products&quot; in the licensing sections of the bill. <br />

2. Tell your story on how switching to an e-cigarette has changed your life.<br />
<br />
3. Explain that H 4074's provision that claims to cap the &quot;vapor product&quot; tax at 10% the excise tax levied on cigarettes is legislative fiction. In fact, if H 4074 is passed, you could end up paying an additional $1.50 each time you purchase a 30 ml bottle of liquid.  <br />
<br />
4. Note that South Carolina citizens and businesses do not support new taxes and burdensome regulations. Further explain that imposing these laws on e-cigarette sales only serves to protect cigarette markets and will hurt small businesses in Oklahoma. <br />

5. Explain that your biggest concern about this legislation is that it is a part of a demonstrated pattern by R.J. Reynolds to get bills introduced in state legislatures (including RI, NC, and OK) that seek to give the e-cigarette industry to large tobacco companies. The three major tobacco companies -- Philip Morris (<acronym title="Private Message">PM</acronym>), Reynolds, and Lorillard -- already have contracts with all licensed tobacco retailers for sales, prime display shelf space, discounts, advertisements and promotions -- while very few e-cigarette companies do. <br />

A hearing on A.B. 7106 was held on May 22, 2013 before the Assembly Health Committee.  <acronym title="Consumer Advocates for Smoke-free Alternatives Association">CASAA</acronym> has received word that A.B. 7106 was not brought up for a vote.  However, the committee chairman is free to bring the bill back up at a later date with minimal notice. <br />

Continued vigilance is needed to ensure that A.B. 7106 does not become law.  Please continue to mobilize New York vapers to respond to the below Call to Action. <ol class="decimal"><li style="">Define electronic cigarette products containing nicotine to be &quot;tobacco products&quot; under New York law by redefining the term to mean any product &quot;containing tobacco or nicotine that is intended or expected to be consumed.&quot;</li><li style=""><b><font color="#FF0000">Impose a 95% wholesale tax on e-cigarette sales.</font></b></li><li style="">Increase New York's tax on smokeless tobacco from 75% to 95%, a 27% increase.</li><li style="">Require e-cigarette vendors to obtain a tobacco retail license to sell e-cigarettes. 4. Tell them that this year, committees in the Maine and New Mexico legislatures rejected bill with similar broad redefinitions of &quot;tobacco products.&quot; <br />

5. Since many/most e-cigarette sales are made online, enactment of this legislation would negatively impact businesses in New York that sell e-cigarettes, as many consumers would choose to use out-of-state and international online suppliers.<br />

6. Many smokers who switch to less hazardous electronic cigarettes do so because e-cigarettes are less expensive than cigarettes. Increasing the costs of e-cigarettes to that of cigarettes would discourage many smokers from switching to e-cigarettes. HB 138 has been scheduled for a hearing before the House Revenue &amp; Finance Committee on Wednesday, June 5th at 3:30 <acronym title="Private Message">pm</acronym>.  The meeting will be in the House Majority Hearing Room of the Legislative Hall, which is located at 411 Legislative Ave in Dover, Delaware.  We need harm reduction advocates to attend and testify against enactment of HB 138. <ol class="decimal"><li style="">Tax electronic cigarettes by redefining &quot;tobacco products&quot; under Delaware tax law to include any product &quot;made or <u>derived from tobacco</u> that is intended for human consumption . . . or any component, part, or accessory of a tobacco product.&quot;</li><li style="">Impose a wholesale tax on all smoke-free products (e-cigarettes, smokeless tobacco, dissolvable tobacco) of 30%.  E-cigarettes are not currently taxed under Delaware law, but enactment of this bill would constitute a 100% increase for adult smokeless tobacco consumers.  The Delaware Department of Finance will be given the power to decide whether this tax would be applied to e-cigarette disposables, liquid, mods, cartomizers, atomizers, batteries, etc.</li><li style="">Require e-cigarette vendors to obtain a tobacco retail license to sell e-cigarettes (see <a href="http://delcode.delaware.gov/title30/c053/sc02/index.shtml" target="_blank" rel="nofollow">Title 30, §5307</a>)</li><li style="">Make it a crime punishable by up to 90 days in jail and a $1,000 fine for a Delaware citizen to have more than ten &quot;packages&quot; of untaxed e-cigarettes.
