My friend was just reprimanded by the manager at Olive Garden last week. She was in the smoking section using the electronic cigarette. She's not sure who told the manager to investigate...but she did explain what it was. The manager told her that it's admirable what she was doing but he asked that she put it away and don't use it in there again because it looked too much like a pipe.

She did as he asked.

There is no RIGHT to e-smoke. It is always at a business owner's discretion.

You've said that a few times TB.... I would place the emphasis a bit differently though. A private business can decide it's not allowed, just like going barefoot might not be allowed. HOWEVER until a rule is made to the contrary, it is allowed. Allowed is the default position.

This is a little trickier though. She was in the smoking section? Well, TB's position notwithstanding, the manager can't just go up to a random smoker and say hey, you can't smoke Winstons, you can only smoke Viceroys, or cigarettes that look like Viceroys. This manager was skidding on the edge, I think.

Yes, she was in the smoking section. So we did find this very odd. She could smoke all the cigarettes she wanted...but she couldn't puff on something that's not going to emit second-hand smoke.

I never ask permission. I either tell staff what I'm going to do beforehand, or kill objections with logic as they arise. I love guys like that manager and I'd have had 'im on toast. Might well be his establishment but it's my cash I'm spending in there and the sucker's gotta earn it.

Jamie's right, default position is allowed.

I've smoked cigarettes for 40 years. I like smoking cigarettes. I have no intentions of stopping smoking tobacco cigarettes or, heaven forbid the health fascists decide they don't like people smoking e-cigs either. I mortally loathe the smoking ban.

I got my e-cig for two reasons. So I could enjoy a "smoke" with a coffee in a cafe if I so wished and some of my dear friends have non-smoking homes but don't mind the e-cigs. In fact, my friend's husband has one now as well and he loves it.

But, therein lies a problem. I know some see e-cigs as a form of capitulation to the anti-smokers, as a means of playing right into their hands. Others (like me) see it as a way of sticking two fingers up at the anti-smokers.

For the record, the anti-smokers like ASH et al, where once they referred to "a smokefree Britain" are now referring to "a tobacco free Britain". They've had their inch, now they want their mile, in otherwords, total prohibition.

Will that include e-cigs? You can bet your last penny that it will. It's got nicotine in it they'll say. That's made from tobacco. Can't have that they'll say.

And so it will go on.

I enjoy baiting the ban 'ems a bit more than I should, Lady P, and there's enough residual guilt in me to be a tiny bit ashamed of the amount of glee I take from it. But gawd it's been coming.

I shut up and moved over, and kept shutting up and kept moving over, but they never stopped and they never will stop.

I can't have one little corner of the carpet to sit on? Fine, I'll sit in the middle.

This device came along at exactly the right time. I don't now have to get involved in civil disobedience by lighting up in proscribed locations. I can sit tall in the middle.

And the glory is our thing annoys the puritans just as much as real cigs.

They almost have to extend the ban to this. Either way they're straying on to our ground.
