Good article that nails it on the head. Just one thing you forgot to mention,

Second, the actual electronic cigarette device (battery, atomizer, mouthpiece/cartridge) could not be considered a tobacco product.

You forgot to mention that e-cigs can be used via USB ports with pass throughs. So, as the e-cig is physically connected to a computer as a power source, technically, given the argument that e-cigs are a "tobacco product", you would have to classify everyones PC as a "tobacco product" as well.

Knowing our government, nothing would surprise me.
