In our recent blog post, It’s Not About Quitting, It’s About an Alternative with the Electronic Cigarette, we discuss why the FDA was started, break down the definitions of "new drug" and "medical device", and argue that the electronic cigarette is in fact neither, based on claims.

As far as the ECA not submitting anything to the court, please note that the suggestion from consumers to take such action has not gone unheard. The ECA board is determining whether action in response to the ASH submission will do more harm than good.
