Default Customs refusal in Canada

I just found this in the new members area. It was full of interesting info...

Confirmation of Seizure
Great, just got a letter in mail from Health Canada notifying me of seizure of my order from march 13.

Says: shipment violates sections 9(1) C.08.002(1)(a)
Reason's: Drug likely to create an erroneous impression regarding composition or safety. A new drug that has not met prescribed conditions.

Shall be interesting mess to sort out. Talking on phone to one inspector that informed me I cannot be found in the database, and now have to wait for the inspector that initiated the seizure to call. As I understand it only thing to negotiate is sending shipment back to Eastmall and hope they will refund, no chance of talking them into passing order to me.

Having had to call two different numbers for Health Canada inspectors so far, I noticed that all phone numbers there are (604)666-____

And:

Just looked at my original bill, yes, EMS shipping.

Refusal would be proper naming device. I suppose seizure would suggest they will keep it, which is not possible for them either, (since it is not allowed entry). They are sending my order back. Just got off phone with agent that refused my order. Sympathetic ex-smoker of two years. She informed me that the proper licensing is just about complete as a medical device. She did not divulge what company is doing it, I will assume a pharmaceutical company has struck a deal with Chinese manufacturers. She told me that the liquid will not be importable and that the cartridges will be classified "schedule F" meaning prescription only (from doctor). Anyway, she said rumor on her end was; that it may be as soon a few months away.

Was your shipment going into Canada or out of Canada? I just sent an e-cig back to E-Puffer.com in Canada on April 7th 2009 & guess what? E-Puffer still doesn't have. Anyone had problems sending returns to Canada? Guess I have to open an investigation with the US Postal Service to see what the hell happened?

Yup - Just as many of us have been saying. Once they get control, their cut of the money will come in, and everything will be OK. It's all about the money.

That's probably why you got it. Mine came through US Customs saying "Toy Gift Box"

just a suggestion but you should all keep the item descriptions to yourself or private message, we're not alone on these forums and revealing those methods will just hurt us in the future,
just my 2cents

Before yet another thread drags completely off topic, let it be noted that this is one of the most interesting revelations I've read anywhere on the forum. We have no idea what is going "behind the scenes" in Canada or with the FDA. If this posted information is correct, then we're in for a quantum change of direction -- but e-cigs will survive.

My guess for a long time is that FDA approval finally will go to a single-unit, disposable e-device with a regulated, measured quantity of nicotine produced by Big Pharma. The device and its contents might be prescription-only, or might be marketed with other over-the-counter NRT products. Liquids containing nicotine will be banned for sale and importation.

I agree with your assumption. E-cigs may not end up illegal but the practice will never be the same. No more buying a variety of exotic flavors from anonymous overseas sources or buying the coolest looking vaporizer you can find online.... From the FDA's perspective the way it is right now is far too haphazard.... They will take all of the fun out of vaping...

To give an idea of how badly things have degraded in Canada in terms of Health Canada's autonomy, check out this story. It is very disheartening to watch the steady erosion of freedom.

Cut ties between Health Canada, drug companies, grieving MP urges
