Thread: Are any of the eCig retailers here required to have a Tobacco Retailer License or ATFE bonding?

    Question Are any of the eCig retailers here required to have a Tobacco Retailer License or ATFE bonding?

    As the title of this thread asks, are any of you who own businesses related to the retail sales of eCig products required by some Federal/State/County/Municipal law(s) to have an active Tobacco Retailers License in order to operate legally? Taking the question one step further, are any of you commercial eJuice makers required to register with the Federal ATFE and be bonded the way tobacco manufacturers are?

    I ask because I'm considering the prospect of starting a business related to the support of eCig retailers and wish to begin getting a layout of any current or pending legalities I may need to be aware of. Like I say, I'm just considering. I've not done a business plan. It's all sort of in the larval stage, but provided the legal hurdles are not too daunting, I may proceed further. I'll greatly appreciate any answers, info or feedback any of you can give me on these questions.

    Note to Mods: I wasn't sure if this was the best place for this post, but it seemed like a pretty good one. Feel free to move it if there is a better location around here that I missed.

    We maintain a business license but it's not specific to tobacco products. That could change with the FDA's deeming regulations. But so far "specialty retail" covers it with a standard business license. (At least in Virginia)

    Thanks for the reply and information, Mac. My guess is I'll find similar requirements in most States and their Municipalities, at least for the time being. It is obvious to me that I need to become more familiar with current and pending legal, legislative, political and other regulatory issues and situations of this environment. Understanding that arena should help me get a better sense of what we might expect to see down the line. Again, thanks!

    California is the same way....standard business licenses. City license, county taxes....all standard business rates.

    Lack of regulation on the home-brews has always concerned me, but so far we've all been really lucky.
