Very complicated topic. To get whole picture try wading through it all.

For a very incomplete, biased cilff note approach:

IMO, Big Pharm and Big Tobacco are lobbying states and feds to ban e-cigs. E-cigs are the first REAL competition they have ever encountered that seriously threatens their strangle hold on those of us addicted to nic and analogs. So it has to be crushed.

Again, IMO, if you want to get off tobacco, get e-cigs. Study, research and find the device(s) that work for you. Learn how to make your own Juice. Focus on what you want, not on what you do not want or are afraid might happen. Get started now to enjoy vap'n and start lessening your nic levels.

Do this and you will be fine regardless of what the money whores in congress, state governments and the FDA do or do not do.

California just passed legislation a few weeks ago banning the sale of e-cigs until the FDA approves them. Right now, we are all calling/emailing/tweeting Gov Schwarzenegger to veto the bill, because it is the last chance to stop this bill from becoming law.

As goes CA, so will go many States eventually.

The FDA tested only two brands of cartridges and found trace amounts of nitrosamines, which are common to every type of tobacco-derived nicotine.

And in one of the 20 cartridges, they found a small amount of ethylene glycol in one of the cartridges. Ethylene glycol is not generally found in e cigs, but this e cig manufacturer obviously had a quality control problem and the cartridge was contaminated.

In any case, the FDA via the media politicized the issue -- going on and on about the "carcinogenic nitrosamines", even though the amount found in e cigs was even lower than those found in Nicorette gum or Commit lozenges, both of which products are FDA approved & available over the counter -- and immensely lower than the amounts found in cigarettes. And the "ethylene glycol" was made to sound as though it was some "essential component to e vapor", rather than just an accidental contaminant in a single e cig cartridge.

In any case, now State and County governments feel forced to "do something about e cigarettes" and many are passing laws against them until the notoriously slow FDA approves them. If that happens, we won't see a legal e cig until doomsday.

To add insult to injury, major pharmaceutical industries and the cigarette industry have combined forces to finance a campaign against e cigs with our legislatures, because both groups lose money when we are using e cigs and not their products.

The whole thing irritates me to no end!

What I wonder is... How could they ever ban the hardware? I mean, the FDA has no jurisdiction over batteries. And, as far as I know, there are no controlled substances in an atomizer. Blank carts are just plastic and poly fill.
So in my mind the only thing that could ever be banned is the juice and the use.
The use is easy to get around as it is SO easy to stealth vape. I have vaped in rooms (and stadiums) full of people and no one was the wiser.
That just leaves the juice. Even that could not be banned in 0nic form. My wife mixes up PG and lorann flavors and just vapes that. So really all that's left is the nicotine. To me it seems like that's ALL the FDA could ever control.
    Am I missing something?

yep, you're missing the whole "drug and drug device" argument that the FDA is using. It's not about it being a battery or atty. The hardware is a medical device according to the FDA and therefore subject to their rules and regulations.

Won't be long and liquid Nicotine will be banned.

I highly doubt the hardware will be banned.

Getting our e liquid will be a pain in the ass.

    Best to stock up.

So someone couldn't sell an atomizer as a glove warmer and a battery as a battery

Well, I suppose they CAN do whatever they want to try to elude the law. But legally, if there is a ban, no. It's my understanding that the juice, carts and everything else go together as a drug and drug device. The FDA is going for the whole enchilada, not just bits and pieces.
