    By the time big tobacco backs the FDA, we don't stand a chance. Nice thought though...and I'll still put in 10 bucks.

    The doctrine of Sovereign Immunity would not allow us to sue the FDA since it is a part of the Federal Government. Only in certain cases where the Government has waived their sovereign immunity is suing the Federal Gov. allowed.

    Even if we could sue the FDA and win, any payout by the FDA would ultimately come from the taxpayers(since the FDA is funded by our taxes). So we would , in essence, be suing ourselves.

    Governments have been sued before, and you didn't say whether or not your willing to pledge $10, lets leave the what we can and can't do to the lawyers. Markarich are you in or out? The idea behind this isn't to make money it's to let the FDA know that when they start lying and twsiting facts for their own purposes and those purposes are not in the best interest of the public that we the people will hold the FDA and other organizations accountable, forcing thousands of people to use deadly tobbacco when a safer alternative is available is not right. The FDA and Health Canada could have stated from the beginning that they support the idea of safer alternatives to tobbacco smoking and will allow pv's until further studies can be made to determine the long term health risks if any. Instead they chose to use scare tactics and forced people to believe that smoking tobacco or quitting are the only two options.

    Ps left out their third alternative which is their own approved cessation products which don't work for 95 percent of the smokers out there, especially for the long term.
