What I'd like to know is how does a retailer carry this on their shelves when the FDA is turning away shipments? Doesn't seem quite fair to those who have taken the hit and had their shipments denied entry.

The simple answer is that real enforcement has not begun. For whatever reason, the FDA has not stepped up a crackdown since issuing statements about e-cigs being illegal to sell or import.

We do not want to hasten the day when enforcement becomes serious enough to remove existing stock from sellers. See the thread on Illegal in Singapore to see what COULD happen.
