Yury, because of the "grandfathering" provisions of the legislation that seems poised to be passed. They essentially exempt products that were marketed in the US before February 2007 from many of the new approval and regulation provisions.
So, if ecigs were considered a tobacco alternative, and not a drug device, they would be in much better shape for remaining lawfully on the market, if it can be shown they were fully being marketed here before that critical date (and if that date does not get changed in the bill finally passed).

My understanding is that the date is only relevant to the e-cig if the e-cig is "tobacco." If the e-cig is a drug/delivery device, the date and this bill have no significance. For other valuable harm reduction approaches (snus, etc.) this bill is very significant.

That day is specified in the bill heading for approval and ultimately law. Feb. 7, 2007.
Why? It was in an older bill and not changed, proponents argue. But is also eliminates grandfathering in the Camel Orbs, Sticks and Strips, the Camel snus products, and all electronic cigarettes. Why is that important? Read on.
If approval of a new product is sought, it will be considered by a scientific panel and the proof level is a pure Catch-22: No one can meet the proof standard, so all new products and those introduced after Feb. 7, 2007, are banned.
This impacts RJ Reynolds, P. Lorillard, some small innovative companies and the Chinese makers of e-cigs. Philip Morris, the company that worded must of the bill, is unfazed since it has no new products since that date.
PM wins. Competitors and smokers lose.

PM made a business decision to take a lead role in writing this legislation to essentially lock in their market leading position, eliminate some competetive products and makes it costly for other companies to introduce new harm reduction products. Wrap it around kids and say this one is for Ted, and, well, you know how it goes.

In 1987, the FDA blocked Advanced Tobacco Products' Favor Smokeless Cigarettes, which was a "plug impregnanted with a nicotine solution" inside a cigarette-looking tube, by declaring it a drug that simply delivered addictive nicotine into the body.
