Again today, there was no movement on the Docket Sheet, but I do have a feeling that this is the week. I think when we see the written decision, it is going to be a very "bullet hole" proof ruling made to withstand an Appeal.

Sun, are you thinking that there would be no appeal to a ruling that is against PV?
or an appeal would have to have deep pockets to stand up for a long litagation?

I've been following this thread since July when I got my first e-cig and for the life of me I can't remember if the FDA ban would affect e-liquid. I assume that if the juice is derived from tobacco then it would be exempt from the ban since it is a tobacco product. What about juice that is made from synthetic nicotine, would that be considered a drug and fall into the FDA's jurisdiction? Or is the juice part of the product and fall into the "intended use" category and fall under the FDA's jursidiction? Am I incorrect on all counts?

Box--no matter who prevails, an Appeal is going to be filed and I do not think there will be any stays pending appeal if the FDA wins.
