( I was going on the verbage in the cover-story by Elizabeth B, posted around 178. Reporters! geesh. ) quite the coincidence it was filed on the same day flavors became illegal (sep 22) Thanks again!

Sea--a few months ago, the Legislature gave the FDA the power to regulate tobacco. Prior to this Act of Congress, the FDA did not have jurisdiction over tobboco. This legislation grants authority the U.S. Food and Drug Administration to regulate tobacco products. Among other things, the FSPTCA provides FDA with regulatory authority to regulate marketing and promotion of tobacco products and to set performance standards for tobacco products to protect the public health.

The class action suit is asking for at the minimum $5 million in monetary damages, AND injunctive relief.
SE's most recent motion addressed the issue of the costs of further litigation based on FDA actions. They argued this most recent class action suit, and others to follow (all citing the FDA) other lawsuits will break them - Collateral damage caused by improper FDA actions, basically.

Even though I find this whole thing assanine, seems to me this jerk should be sueing the FDA for not putting thier findings out ealier. What say you Sun

Surely SE and Njoy Lawers must know the date of the next Hearing.
They do have to be informed in plenty of time when they are next due in court don't they ?
I mean they don't have to sit in the Courthouse waiting for the Judge to come back from playing Golf or anything do they ?
They don't get a phone call on the morning of the Day to say" Hurry up, your on in two hours" do they ?
Legalone ? Sun ?
This is becoming a Farce.

That wouldnt really fit in with anti-ecig/smoking in generals plan. Why bite the hand thats feeding you when you can finish off a staggered foe...

There is no next hearing set. Everyone is waiting for the judge to issue ruling. Judges often like to issue blanket rulings covering all open issues. In the past couple of months since the last hearing, we saw multiple submissions that require response. Presumably, once there is a week or two without any new issues, the judge will issue a blanket ruling.
