Well, Elaine, we don't know how it will go yet, but it certainly is possible that Judge Leon will agree with SE and Njoy, and rule that the e-cigarette does fall within the FSPTCA's definition of "tobacco product". If that were to happen, then the question becomes how it should be regulated under the FSPTCA, and Bill's suggestion is the one we would need to get behind.

I still don't see how a ruling on this case is good. The most likely outcome is one of two, neither of them good for us. Banned or FDA regulated in which case good-bye to flavors and hello to nic regulations. Who knows if SE doesn't see a potential profit after the ruling there might not even be an appeal. It cost a lot of money to take this to court.

Brwster--Funding the litigation is not really an issue for SE or NJOY. And only on Appeal, will we get some affimative rulings. It is time to move forward and stop hiding under a rock. Stock up if you can and lets see this show though to, what could be, a resolution that is doable for all concerned. I know ASH has backed way off the e-cig since it's conterpart in the UK gave the e-cig the thumbs up. So it is time to end the mystery of the fate of e-cigs.
