This event though I think is for the benifit of something that is tied to the case, and will not change his ruling. I am thinking more and more it has to do with that commenting period for the FDA on the new tobacco regulations that was extended till Dec 28, 2009.     Thanks for the clarification Sun ,
    so the (current) delay is about allowing time for comments to be put
    and settle, presumably after that there's no other reason for delay...

    That would be my take Exo. There always could be other reasons, but this seems to me to be the most plausable.

    If this is out of the ordinary, Sun, can we not infer that something (perhaps nefarious) might be transpiring between parties? Or, is this kind of delay fairly common?

    I still say no matter the ruling its going to be a very hard to out right ban ecigs due to one fact it will cost a lot of money to hold the borders. If it runs dry here all you have to do is have some one in the UK or anywhere in the world suppling to America. And they will do it. To make the money. Plus the amount of law suits will place a huge burden on the court systems... they will have to give to the people one way or another.

    Risky--Counsel for SE stated that there are no negotiations going on so it is all or nothing--no settlement, so an Appeal is sure to come.


    As for banning, people forget that shutting down shippers, such as DHL and EMS and merchents such as Visa and Mastercard will be the most effective way to kill the industry.

    I agree with grimmer.

    However, I'm not so much worried about a ban as I am about vaping being included in current smoking regs. e.g. No smoking\vaping within 50ft of an entry, etc..

    Once vaping has been classified the same as smoking, then it will be VERY difficult to reverse later, even after the phobia has diminished.

    By having the same regulatory authority with vaping as the FDA currently has with smoking, it tells the world that there is NO DIFFERENCE and we should be kicked for doing either!

    For this reason, I also disagree with conceding to diminished recommendations in commenting to the FDA (as suggested earlier). DO NOT CONCEDE ANY authoritative controls or restrictions to the FDA. Yes, they may be granted some authority after this, but don't give the impression that it is just hunki-dori with us to do so.

    For the most part it has SNM--For a product that always needs to be readily replenished like e-cigs--the comaprision would be very difficult to square.
