It is unfortunate but I noted the Howard Stern clip months ago. Sometimes I wonder what SE is thinking.
I wish a responsible supplier / vendor put this product through it's paces two years ago with a different administration at the helm (not that I agree with the Bush admin in gen but ecigs would have probably gotten rubber stamped) . Granted testing to submit would have been 80k plus but the seller would (and has) profited from this result to the point of recouping costs, you must consider that it was an unknown product two years ago and would have most likely flown under the radar and been approved. Know it is known that it works and I fear lobbyists are doing there best.
Instead SE they tried to use a lame loop hole and we are now all stuck in a mess. How could they have been so foolish. I appreciate the fact that they are flipping the bill legally but the company still reeks of mistrust.
I try not to play the “What If” game but now switching to ecigs I wonder why SE was so foolish.

Do you think it is possible that Judge Leon was waiting for this http://www.e-cigarette-forum.com/for...udy-vapor.html to come out before issuing his verdict?
I mean, I am sure studies take time, and NJOY informed the judge of this study as it was ongoing, so he didn't want to release until the results of this study came out.

Not at all Darmeen---this litigation is about jurisdiction, not saftey.

So what would the comments left for FDA have mattered? Wasn't that one of the potential reasons for delaying?

Judge ruled FDA has no authority to regulate as a drug/device - hit FDA hard for their circular arguments.
