I wouldn't really call it conflicting evidence. It still is only using what the FDA sent out. And picking it apart piece by piece explaining why it is flawed, and explaining why and how the FDA proved that it is realitively safe. After all, isn't that what the judge wanted, to hear what NjOY and SE had to say about it. However i too see the judge taking the easy way out by ruling deference on the case.

Iron--My take? This is the Titanic sinking and we are half way up in the air about to plunge into the icey waters of black market purchasers for those that missed the "stockpile" life boats. There simply is nothing for Judge Leon to hang his hat on unfortunatly.

I sent a message to Judge Leon. E-cigs have recently been banned from my therapy provider (VA).

So they may make me take up smoking again. I'll hate doing it, but whatever.

Again no movement on the Docket Sheet again. The upcoming Hearing is getting much publicity in the press now and we can rest assured that Judge Leon will be ready.

Today, again there was no movement on the Docket Sheet. There are only 10 days left till the hearing before Judge Leon. If the parties are going to file any pre-hearing briefs, it will be very soon. I understand that the Court Room will be standing room only for the hearing.
