I had already emailed the Rules Committee members, as well as the 2 Representative sponsors. Sent them my comments as well as a copy of the Health New Zealand report and links to the AAPHP site and to Dr. Siegel's site with a recommendation to share the info with all...

Docket Update March 18, 2010
Again no movement from the Court today as the assault from several States attempt to ban the e-cig continues.
Anyone writing Congress should be citing this case and parts of Judge Leon's ruling. Although not yet binding, these States should be deferring to the Court until this case is fully adjudicated.

If the outcome of this case is that e-cigs are ruled to be a tobacco product under the jurisdiction of the FDA, do you think these state bans will be constitutional?
It would seem to me that states could ban sales to minors, restrict where vaping can occur, that sort of thing, but that a state law calling for an outright ban would get overturned.

The States would adhere to the FDA regulations. These States are jumping the gun for the simple reason that should Judge Leon's ruling stand, then as a matter of law the e-cig would be a product that the FDA can not ban, but rather only regulate.
