Anyone writing Congress should be citing this case and parts of Judge Leon's ruling. Although not yet binding, these States should be deferring to the Court until this case is fully adjudicated.

What exactley does a State Ban do? OK so you cant sell in that State but my friend is in Oregon which Im sure he has said it is banned there but he still gets all his supplies without a prob. I guess it does end vaping everywhere though.

Just a note: hard copy letters with signature and return address sent 'snail mail' AND stamped through USPS have more IMPACT than emails ...

Well for one is this is really going to put a damper on your friend having no problems. Unless you want to drive to another State whenever you need product as you will not be getting it in the mail.

They are squeezing us into a corner, ban the e-cig, go back to smoking and pay the outrageous taxes or quit.
The only thing we will have left to enjoy is a nice candy bar and a coke....oh, wait a minute, they want to tax those out of existence too.
I am too angry and disgusted to say anymore, I might get banned, or arrested.

Sun,
You stated on the PACT Act "Being signed into law today".
I know it passed the Houses, is the Pres gonna sign it today?
When signed by the President, will it be immediate or will there be a time to activate?
Your insight is always appreciated.

Vaporer--it is on track for a signature, but there are still a few details to work out. You can track it here. Mind you it does not speak to e-cigs, but we will see how it all plays out.
You can track it here: S. 1147: PACT Act (GovTrack.us)

Thanks for the quick reply Sun.
Since Judge Leon didnt rule them as medical devices, its pretty easy to see where all this is attempting to go to and how it can be construed to vaping, snus, snuff and home delivery.
Even if exceptions are made, it will be costly and not user friendly from what I read.

Docket Update March 19, 2010
Today there were no rulings from the Appeals Court while several States continue their legislative attack by trying to advance bills to ban the sale of e-cigs.
An Administrative Stay that lasts over a month really is pushing the "spirt" of the rule. I can only hope Judge Leon's decision is affirmed.
