Question When FDA to Vote on Eliquid Ban

Does anyone know what the date of the vote for this proposed ban is? I keep hearing "this summer" but I havent yet heard when exactly.

Also, what is your opinion on the matter? Do you THINK we will get the axe or do you think we're fine?

Personally, I'm very worried, yet i remain optimistic.

CASAA: New York State Call to Action When I look at some of these threads that have 1,000+ views or even the largest thread on the forum with almost 1,050,000 views, I can't help but to wonder would this even be an issue if just a small percentage of us would call or write a letter. After reading the CASAA website, I think I will forfeit a few juice purchases and throw them some support, as well as getting off my bootay and writing a letter. And when I get bored...I will just vape and dial! The numbers and the addresses are printed on that link. All of us here type and post quite often, why not type and post an email to a senator...that's gangsta!

I just completed a couple steps

    1) Becoming a member of CASAA (not financially obligatory)
    2) Became a monthly donor (practically any amount you can)

    Steps yet to complete

    3) Emails
    4) letters
    5) phone calls

right on right on right on. i also was able to get some info from a seasoned veteran.

First, since the Tobacco Act did not include e-cigarettes (and several other tobacco products), the FDA would need to issue a "deeming" regulations stating that the Secretary deems e-cigarettes to be included in the products it will regulate under the Tobacco Act. There would then be a public comment period, after which the FDA would issue a final rule on which products it deems to be under its purview.

Second, the FDA could begin issuing draft regulations that affect e-cigarettes. Each proposed regulation must be posted on Regulations.gov and allow a public comment period. After that, the FDA would issue the final rule.

So what we are talking about is not a "ban" per se. However, the FDA could issue regulations that result in a de facto ban. For example, if they go forward with applying section 905(j) and announce that all e-cigarettes that were not on the market in February 2007 must be taken off the market, that would eliminate 510s, KR808s, eGos and similar devices, Mods, etc. That could not happen until the FDA first issued a deeming regulation, and second issued a specific regulation affecting e-cigs.

I have heard rumors that the FDA will issue the deeming regulation next month, but it could happen next week or it could happen many months from now.

The public comment period for each proposed rule or regulation is usually 60 days. It can take several months after the comments close for a government agency to issue a final rule. So the short answer is "not immediately" and the long answer is anybody's guess.

When it comes to writting govt officials I have mixed opinions. If the right people compose letters, it can be a good thing. Correspondance has to be well thought, professional, objective and address concerns in a constructive matter.

Supporting CASAA seems like a great idea and Im all for it
