Exclamation To the states banning sales of e-cigs

These bills are almost identical in wording. I think it would be a great idea to have our own form letter written, ready to fax to the appropriate people in our own states goverment.

We really don't want me to write it, I feel way to much like BigJim, but I can't control myself as well as he does.

Would one of the calmer, more articulate members of our little group here care to partake in this venture?

This would be the place to post them.

    please, please, please.

If this has been done, point me in the right direction.

The people who invented ecigs should be given the Nobel Peace Prize.

FYI, this is important, i have NOT looked at the other states laws except illinois and this looks to me like banning sales to MINORS.

They both fall under heading A here.
Illinois General Assembly - Full Text of SB3174

    (a) Sale to minors. No person shall knowingly sell, barter,
9 exchange, deliver or give away or cause or permit or procure to
10 be sold, bartered, exchanged, delivered, or given away tobacco
11 accessories or smoking herbs to any person under 18 years of
    12 age.
13 (a-5) Sale of bidi cigarettes. No person shall knowingly
14 sell, barter, exchange, deliver, or give away a bidi cigarette
15 to another person, nor shall a person cause or permit or
16 procure a bidi cigarette to be sold, bartered, exchanged,
17 delivered, or given away to another person.
18 (a-6) Nicotine delivery products. No product containing or
19 delivering nicotine intended or expected for human
20 consumption, or any part of such a product, that is not a

That's what they want you to believe. Look carefully at the wording. Neither a-5 nor a-6 specify the age of the recipient of the product. In a-5, "another person" is the wording. In a-6, the wording is "consumers" -- NOT "minors".

We need to write to urge them to substitute "minors" for "consumers" in a-6 to clarify the legislation.

Since we are not concerned about "bidis" let's not complicate the issue by even mentioning them.

Vocalek is right. They are front-loading the bill with big bold letters that hit upon the "protect the children" theme, so that most people who stop reading the bill after that header won't notice in the fine print below, it really means "all people". The wording about "kids" was completely unnecessary as it is already contained within the larger scope of the bill.

They have pulled off a simple legal trick which subsumes the smaller context "kids" into the larger context "all people" without you noticing (unless you read the whole thing carefully).

The synopsis on this page tells the story: Illinois General Assembly - Bill Status for SB3174

    Talking Points:

I am contacting you about Illinois SB3174. I urge you to amend this bill so that the prohibition of the sale of products containing nicotine applies only to minors. Nationwide, the number of adult smokers that have been able to substitute what is commonly called an electronic cigarette (or e-cigarette) for all of their tobacco cigarettes is approaching a million.

<Insert your personal story here - Talk about how long you smoked tobacco cigarettes, how much you smoked, how it affected your health. Talk about the effect that switching to inhaling vaporized nicotine has had on the number of cigarettes you now smoke and the positive effects you have seen on your health.>

The University of Alberta conducted a survey of e-cigarette users. All respondents previously smoked. Over 87% of users are older than 31 years, with 32% more than 50 years old. Most -- 79% -- are using e-cigarettes as a complete replacement for their tobacco cigarettes.

    http://www.tobaccoharmreduction.org/wpapers/011v1.pdf

I urge you not to remove this remarkably successful tool from the arsenal of the ways we have to reduce the harmful effects of tobacco cigarette smoking.

    Sincerely,

Default How to fight the ban in New York State

See this post if you do NOT live in New York
    http://www.e-cigarette-forum.com/forum/casaa/77088-ny-state-bill-banning-ecigs.html#post1165143

If you do live in New York, make two phone calls -- one to your state Senator and the other to your Assembly representative.

The links to find yours can be found in this post (See Response #7):

Default This is more what I had in mind

Please provide input, modify this in any way you want. Add some more here to's and there fors legal it up a bit.

The idea is to have something we can send to our state's legislature that looks like an actual bill ready to go before the house or where ever it goes before first.

Where I have typed federal just replace it with the name of your state.

I hope you all realize we are not going to be able to continue to use our liquid nicotine with out some kind of tax. The stamp system is the easiest and fastest way to get this going I think.

Some kind of regulation and saftey control has to be implemented to protect us from inhaling toxic substances into our lungs. I'm not sure but I don't think it would take very much lead inhaled to mess you up for good.

I for one am also tired of the junk made in China. There is a huge oppurtunity for the creation of brand new jobs here in the USA. Manufacturing of a quality, dependable product that is only possible with American skill and know how.

Sure it is going to cost more. Let us not forget that the cost per day at the ICU of your local hospital is currently around $7000.00 per day. Don't forget to figure this cost into your savings calculator.

Liquid nicotine requires the following controls:

No sales to persons under the age of 18.

Child proof containers should be the standard. If this provides difficulty for some people, as does medication containers, a normal bottle can be requested by the consumer.

Each bottle shall be properly labeled as to the contents of such bottle.

Periodic inspections of liquid to verify contents and strength of nicotine

The following is an outline of an exceptable bill IMO. Please offer suggestions to this.

FOR THE CONSUMER OF LIQUID NICOTINE

A stamp will be purchased annually from the federal goverment by the consumers of liquid nicotine to off-set the cost of the e liquid inspections. The cost of the stamp is yet to be determined.

No person shall use, or be in possesion of liquid nicotine containing substances with out having said stamp in their possesion.

Use of liquid nicotine with out the stamp shall be considered a misdemeanor punishable by a fine of at least ten times the cost of the annual stamp.

Recurrent offenses shall be fined accordingly. Second offense 15 times 3rd offense 20 times.

Multiple offenders with greater than 3 offenses shall be charged with a class C felony and be incarcerated for a period not to exceed ten years with a minimum of two years served. They will also have their privelage to purchase a nicotine stamp pemanently revoked.

FOR THE DISTRIBUTORS OF LIQUID NICOTINE

A license will be issued bi-annually to distributors of liquid nicotine. Liquid nicotine distributors shall be subject to unannounced inspections of their liquid nicotine product with a minimum of one inspection occuring annually.

Any person or persons selling liquid nicotine with out the proper federally issued license shall be charged with a class C felony and subject to 10 years incarceration and a $50,000 fine. Their privelage to have a license to distribute liquid nicotine shall be permanently revoked.

Any person or persons selling liquid nicotine to a minor will have their license revoked immediately and be ineligable to re-apply for a period not to exceed five years. Fines and legal charges to be determined at a later date.

Any person or persons selling selling liquid nicotine to another person or persons and not requiring proof of a federally issued liquid nicotine stamp will have their license revoked immediatley and be ineligable to re-apply for a license for a period not to exceed five years. Fines and legal charges to be determined at a later date.

If a distributor of liquid nicotine fails an annual inspection they will be given one week to correct the violation(s). After such a period of time has elapsed if the distributor continues to be in violation, the distributor shall have his license revoked for a period not to exceed two years.

Something like this I could live with.

The people who invented ecigs should be given the Nobel Peace Prize.
