Iowa AG Tom Miller and others (most of whom previously advocated FDA’s disastrous Deeming Regulation) send letter to FDA Commissioner Scott Gottlieb:
- pointing out and urging FDA to recognize the Deeming Regulation protects TCA “grandfathered” cigarettes by banning virtually ALL vapor products and by imposing extremely costly PMTAs for ALL very low risk vapor products, and urging FDA to:
- acknowledge that vapor products are far lower risk than cigarettes,
- support regulatory policies that:
- encourage lower risk tobacco/nicotine product innovation,
- delay vapor prohibition day (i.e. PMTA deadlines) by at least 4 more years,
- move to a reasonable and responsible “standards based” regulatory regime,

The letter by AG Miller et al to FDA's Gottlieb is truly excellent because most cosigners had previously endorsed FDA's Deeming Rule and because it recommends delaying all PMTA related deadlines for vapor products by at least 4 years, and establishing a reasonable vapor product standards regulatory scheme (as Duncan Hunter's bill does) for vapor products.

This letter should convince many public health officials and tobacco controllers to abandon the vapor prohibitionist and anti vaping propaganda coalition controlled by Legacy (especially since Tom Miller is Chair of Legacy's Board and since Abrams and Niaira work for Legacy), Big Pharma financed CTFK/ACS/AHA/ALA/AAP and leftovers from Obama's DHHS.

The FDA could reverse themselves by reasoning that there has been some more science since they started down this road that isn't supporting draconian measures. Delaying the restrictions while still more science comes in seems reasonable too.

I'm intrigued by the report of a drastic decline in kids vaping. I wonder how many of those tried ecigs and later stopped. I believe vaping is not so habit forming for kids so it's easier to stop when their curiosity is satisfied. It would be interesting to see if the surveys are tending to confirm that.

That's nice and all, but what is going on here?
This sounds like a monumental shift, if not a full 180 here.
How? Why? What?

Some of the folks who, in the past, deceived the public about vaping and lobbied FDA to ban vapor products, now realizing that FDA's Deeming Regulation will protect cigarettes and will harm the health of vapers and smokers.

The split within Legacy lies initiative (which has lied about vaping and lobbied FDA to ban vapor products since 2009) is especially striking, as Tom Miller is Legacy's Chairman of the Board, Cheryl Healton is the former CEO of Legacy, and David Abrams and Ray Naiura are leaving Legacy (because Legacy's current CEO Robin Koval is a vapor prohibitionist and propagandist).
