The bill does not look bad except for the fact that they exempted BIG tobacco from regulation. I do believe that there need to be some regulations enacted concerning the production and sale of ejuice from a safety standpoint. There is a fair amount of shady liquid out there and it will only take one outbreak of tainted/poisoned liquid to cause a big stink (no pun intended)


Excerpt from HB1432

the term does not include a vapor pen.Sec. 10. "e-liquid" means a substance that:(1) is intended to be vaporized and inhaled using a vapor pen;and(2) specifically excludes substances contained in nonrefillable sealed cartridges of four (4) milliliters or less used in electronic cigarettes.

Wooglins you do realize that the way that law is worded Hoosiers will not be able to purchase any juice that comes from a company that has not been issued an Indiana permit or does not come through an authorized distributor (ie middle man ie broker collecting a fee) no matter what state it's made in.

It's bad

Wooglins, as a Hoosier myself, I must respectfully disagree on the point that, "this bill doesn't look bad". While I agree that some regulation would perhaps be a good thing, this law goes way too far and it appears designed to run all the small businesses out of the vapor industry in Indiana. I really do hope that someone is going to challenge this one successfully in court.

WHAT? This bill is a death warrant for independent IN vape businesses and specifically protects Big Tobacco cigalikes. Quite literally the most atrocious anti-vape bill in the entire nation by a wide margin

Wooglins, This bill will make me a criminal for mixing my own e-liquid.
But the real deal is that it will get any surviving vendors registered, for a fee...Then come the taxes, on gear and liquids.
I don't know why vendors would pay a 5 year fee, not knowing if they are going to be able to survive the taxes and increased regulation.
This has nothing to do with safety.
Indiana wants it's tobacco revenue back.

If we cannot find better ways to motivate vapers to hassle all government to stop interfering based on nothing more than unscientific prejudice and concern for imaginary children, then times will be tough.

SECTION 14. [EFFECTIVE JULY 1, 2015](a) The general assembly urges the legislative council to assign the following topics to the public policy interim study committee during the 2015interim:
(1) Whether smoking should be prohibited in bars, casinos,and private clubs.
(2) The fiscal impact of prohibiting smoking in bars, casinos,and private clubs.
(3) Whether e-cigarettes should be: (A) defined as tobacco products; and(B) subject to smoking bans.
(4) E-cigarette taxation.
(5) The fiscal impact of an increase in the cigarette tax.
(6) Possible funding sources for tobacco use prevention and cessation programs.

I didn't see anything that changed for DIYer's other that if they do commit that infraction

Sec. 7. A person may not manufacture, sell, or distribute; (1) a liquid or gel substance containing nicotine; or(2) a nicotine liquid container;unless the product is contained in child resistant packaging.

So we could still DIY as long as we put the juice in child resistant containers. Maybe.

But this section seems to cast a pretty wide net, and it can easily be read as applying to everybody, not just sellers since it specifically mentions giving it away:

"Except as otherwise permitted by this article, a person may not purchase, receive, manufacture, import, or transport, or cause to be imported or transported from another state, territory, or country into Indiana, or transport, ship, barter, give away, exchange, furnish, or otherwise handle or dispose of e-liquid, or to possess e-liquid for purpose of sale."

I think it will take a while before the meaning becomes clear. The language is rather obscure.
