I think the best thing about this decision is that the court categorically stated there is not proof that vaping is harmful in the way combustible cigarettes are.

If such taxes and the TPD itself is challenged in more national courts on constitutional grounds than the EU would have no other choice but to do more than just note. Totally Wicked in the UK is challenging the TPD within the European Commission itself. I'm much more pleased by the Italian decision.

The ANTZ have a problem when it gets into the courts as they generally rely on facts not feelings, maybes, could happens, what ifs and so on. Facts have a habit of ruining their propaganda.

I left out the lies they use as they would have to be beyond stupid to risk a perjury conviction and leave us with legal proof of their wicked ways.

It is a long road ahead.
From the time the TPD2 gets implemented, people going to court against it in the member countries, the individual high courts eventually deferring to the EU courts, EU court decision-making and things trickling back down to member countries, a lot of time will pass.
