I'm on the road A LOT. I have yet to see a "child" with an Istick and a Griffin. I've seen several puffing on coffin nails though.
Too right, and the FDA lobby are being real careful about how much cigarette smoking has gone DOWN among teens (who are already breaking the law in most states) when they all gasp and blow gas over the increase in teen vaping.

This has been in the works for many years. It all started with the demonization of smokers as somehow sub-human by the health lobbies, and now they're equating vaping to those of us who still smoke. The basic effort started decades back, but really took off a few years ago with the total war against tobacco, and now, the same people are simply targeting vaping. It's always about "the children". We're in deep, deep authoritarian waters here. Cigarette smoking is going to dramatically increase, perhaps the biggest increase in decades if the draconian vaping stuff eventually comes into effect (hopefully not).

Will do, ZM. I am thinking that this will be big news.

I found an old thread for anyone interested in reading about the outcome of the lawsuit the last time the FDA started seizing shipments.

SE, NJoy vs FDA -- court dockets / updates

May need to scroll up a bit in that link to see that it says this

"the third option is just to agree that e-cigarettes should be regulated as tobacco products (absent therapeutic claims) and reach a settlement with NJOY (and, of course, TW). That third option is what we've been seeing hints of for the past week or so--the FDA asking for a continuance in the TW case to talk about settlement options."

Good article. It's a guest editorial in USA Today. ANTZ will point to the disclosure at the bottom of the page, and say COI bias.

Here's USA Today's editorial staff's opinion:

http://www.usatoday.com/story/opinion/2016/05/05/e-cigarettes-vaping-fda-teens-smoking-editorials-debates/83986508/

(Link broken. Copy and paste.)

This quote is the clincher. Who are the major players in the US? Why, it's BT. In China it's Dekang and Hangsen, but the question is whether foreign products will be allowed to come into the US.

They are talking about a separate approval process for each juice flavor, with the different nicotine levels being ANOTHER approval process. For one juice in 0, 6, 12, 18, and 24mg strengths, that's something like $1.5M to put that juice on the market for sale.

We have a long and twisted process to go through in getting something workable. Looks like DIY is the answer, but they know we need nic to do that. Watch for consumer nic bans.

E-cigarette proponents assert that the new regulation will work like a ban because many makers will be unable to get through an expensive and time-consuming application process. The FDA acknowledges it will cost “several hundred thousand dollars” for each e-cig formulation. For major players, this won’t be a problem. More to the point, is that a good excuse for allowing the public to ingest vapor without knowing what’s in it or the potential risks? Of course not.

"It's for the children!" is always their infuriating strawman trotted out for media consumption. Has anyone else noticed that in the "news" stories from the last couple days, that's all they talk about? "Oh, the FDA is requiring that you be 18 or over to buy e-cigs now. Well, that's good. In other news..." No mention of how this will destroy thousands of small businesses nationwide, or make it far less likely that any smoker will be able to successfully quit actual tobacco products. Lying by omission is just as bad as overt deception, (which they also engage in, btw).

We should probably be contacting media outlets as well.

I'm sorry if someone already posted this I didn't read every page but what is the FDA gona do about actual enforcement of this?Theres no way they have the manpower to send all kinds of people store to store seeing who is in compliance.Plus they have other duties so they cant put 100% of staff on vaping. This just doesn't seem thought out very well

"We have a very effective office of compliance and enforcement that will be monitoring and conducting surveillance to detect any kind of illegal activity in the marketplace," he says. "I have no idea what the likelihood is for a black market, but if that happens we'll find it and those products, if they haven't received marketing authorization from FDA, would be in violation of the law." - Mitch Zeller, director of the FDA's Center for Tobacco Products FDA

This is from the Facebook page of a group that owns 5 shops. In response to a poster saying that today the FDA has dealt a “low blow” which threatens to “ban most products,” they responded as follows:
“We will be prepared! Don't worry! Keep yourself informed; and try to educate others on the MANY benefits of vaping!”
I jumped in and said: “I have bought a lot of e-juice from you guy and I particularly like your Banana Nut Muffin and Breakfast Blend. But unless you are prepared to shell out hundreds of thousands of dollars and spend at least 1,500 hours getting these products approved, they (and your stores) will probably be gone. It won't matter how clean your lab is or how carefully you source your ingredients. The only way I can see this scenario changing is if Congress changes the deeming date to allow existing products to remain on the market.”
They responded: “We have been long prepared for this. Changes may happen as this is just the first draft. But customers; trust me when we tell you we will be around!”

“Just the first draft..." So, not to worry! I'm so relieved.

I generally dislike a dialog of pictures or memes as an alternative to actual conversation, but once in a while someone achieves perfection in the simplicity of a picture in response. Well done Ocelot... still chuckling.

I know for certain that in the past 48 hours I have seen something quoted from the FDA saying that they will be prepared to enforce on day 91. What part of this exactly will they be enforcing on day 91? Does anyone here know?

I have read so much but, that keeps coming back to me. Seems like there should not be anything to enforce until at least 2 years from now?

I thought it was the age restrictions that go in at day 91 and the no new products.

Having once been the victim of an FBI raid on the offices of a former employer, I can assure you that you do NOT want to be in a vape shop or juice lab when federal agents come ...

That was over 20 years ago, and I still have chronic back pain from that day ...
