Okay Utah Vapers, it's time to get busy. I know it might seem a little intimidating to call or meet with your State Rep or Senator, but we really need to all work on this if we're going to defeat it.

Go to the online legislative map, input your address and find your Representative and Senator. Call them, talk to them, schedule an in-person meeting if you can... let them know why you oppose HB245(S3). This can make a huge difference!

Perhaps it sounds like something the antis would come up with because that's exactly what it is. Americans for Nonsmokers Rights (hah!) developed model legislation that they have been promoting all over the country.

Worth repeating so that everyone knows what we are up against. ANR, ASH, ACS,ALA and other alphabet soup organizations are heavily funded by RWJF and Big Pharma interests peddling nicotine replacement gums and lozenges. As long as the money and six figure salaries keep rolling in so they can pay for the monthly lease on their Mercedes Benz E350, they don't care who dies.

I've already sent emails to the committee, do you want out of state support for the next step? who should we contact?

Oh yes, thanks for bringing that up! I've updated the CASAA Utah Call to Action page, it now has a list of the email addresses for all of the House of Representatives. If you could send a letter to all of them, that would be wonderful!

I've already heard back from one of them... looks like we might have found some support! :)

It hasn't come up on the Reading calendar yet, although it's possible that it will be on the floor today.

There are now a fourth and fifth proposed substitute for the Utah bill.
This one: Fourth substitute gets rid of the sunset clause, which would be an improvement.
This one (from our long-time nemesis Rep. Paul Ray): Fifth substitute gets rid of all of the exemptions for the hookah and e-cig shops, which would essentially put the bill back to its original form. Geez.

I have no idea how all the players are planning to proceed with this. Although, no matter which version they go with, it would still define vaping as smoking. So we're against it. Call, send letters, faxes, emails... whatever you can do to help!

Ship your Senator a clean ashtray along with a friendly letter, pointing out that you are sending this along because you don't need it any more.

Smoking bans were enacted for the purpose of protecting non-smokers from the potentially harmful effects of second-hand smoke. But smokefree e-cigarettes emit NO smoke and pose NO known health risks to users or nonusers.

Smoke is created by the process of combustion. Setting tobacco on fire creates tar, carbon monoxide, airborne particulates, dozens of carcinogens and thousands of other hazardous chemicals. Inhaling these substances in smoke is the cause of 99% of tobacco-related diseases and deaths. Vapor from a smokefree e-cigarette does not contain any of these substances.

Passing this law will discourage current smokers from switching to the most effective tool I ever found to escape from smoking. There are many reports of spontaneous quitting among smokers who bought a smokefree e-cigarette for occasional use only. This law could have the unintended and tragic consequence of encouraging former smokers to relapse.

Not surprised, unfortunately...

Amazingly (in my mind), right after the Utah House approved the bill to ban e-cigarette use in all public places, the House then approved a bill (sponsored by Paul Ray) that would allow loaded guns to be carried in all public places.

It's legal to openly carry a loaded* gun in Utah. Local municipalities shouldn't be able to cite you for "disorderly conduct" because you're doing something legal that might make someone else feel "uncomfortable."

This isn't a gun forum though, so I'll just leave it at that...

* Must be two actions away from firing (not including disengaging the safety)

It's been referred to a Senate Committee, and is on the agenda for Monday, Feb 27th at 8:00am. This meeting is open to the public, so if local e-cig users could attend, that would be great!

If you can't make it, please at least call, write or fax the members of this Senate Committee.

Please help us get this shut down!

Absolutely! When the bill first came up in January it was in the House of Representatives, and now that it's in the Senate we have a whole different group of people who we need to try to get informed.

Smokefree Pennsylvania sent the following letter to the Utah Senate Committee members yesterday. The Senate committee meeting is occurring now.


Dear Senator

As one who has campaigned to ban smoking in public places for 25 years, I strongly urge you to OPPOSE HB 245 S3 "Amendment to Definition of Smoking in Utah Indoor Clean Air Act" http://le.utah.gov/~2012/bills/hbillint/hb0245s03.pdf because it would falsely redefine "smoking" to include the use of smokefree electronic cigarettes (e-cigarettes) and because it would unjustifiably ban the use of these nonpolluting lifesaving products in every private workplace in Utah.

In sharp contrast to combustible tobacco products, e-cigarettes don't burn and emit no smoke or pollutants. Redefining "smoking" to include the use of e-cigarettes is as insincere and absurd as redefining "smoking" to include the use of smokeless tobacco, gums or lozenges, drinking coffee or tea, or using a cellphone or a laptop.

Scientific evidence has consistently found that cigarette smoking poses 100 times greater morbidity and mortality risks than use of smokeless tobacco products in the US and Sweden, and indicate that all noncombustible tobacco/nicotine products (including e-cigarettes, nicotine gums, lozenges, patches) are about 99% less hazardous alternatives to cigarettes. Smokers who switch to e-cigarettes and other smokefree tobacco/nicotine products reduce their health risks nearly as much as those who quit all tobacco/nicotine use. Several million smokers in the US have already quit by switching to smokeless tobacco products, and about one million smokers have quit by switching to e-cigarettes in the past five years.

While e-cigarettes emit no smoke nor air pollution, they do emit a similar amount of nicotine to the user as do nicotine gums and lozenges.

Unfortunately, the Utah Health Department has made many false and misleading fear-mongering claims about the health risks of e-cigarettes during the past two years in its intolorant zeal to ban the sales of e-cigarettes to adults (in 2009 and 2010) and to now ban adults from using e-cigarettes in all public places. A recently published e-cigarette study at CASAA.org found that 22.5% of participating smokers remained smokefree after 24 weeks and another 32.5% of participants reduced daily cigarette consumption by 50%, including 12.5% who reduced daily cigarette consumption by 80%. The Utah Health Department also has falsely claimed that people cannot tell the difference between a burning cigarette that emits tobacco smoke pollution and a smokefree e-cigarette. In fact, even ...... can tell the difference between a burning cigarette and a smokefree e-cigarette. Instead of banning the use of e-cigarettes, I suggest that Utah Legislators investigate why staff at the Utah Health Department continue wasting taxpayer's dollars making false and misleading claims about e-cigarettes, and why they have aggressively campaigned to ban the sale and use of e-cigarettes.

In contrast to indoor smokefree policies/laws (which are largely self enforced because nonsmokers don't want exposed to hazardous tobacco smoke), it is impossible to enforce an e-cigarette usage ban (since the products can be used discreetly without anyone else knowing). By simply waiting three seconds after inhaling and before exhaling, there is no visible or otherwise detectable vapor. Nobody can even tell if a person is using an e-cigarette or simply holding a pen (which look like most e-cigarettes) to their mouth. Enacting this unwarranted and unenforceable law would just reduce the public credibility of the Utah State goverment.

All of the dozen plus laboratory tests conducted on e-cigarettes found that e-cigarettes emit no hazardous levels of any constitutents, and that the trace levels of nitrosamines in e-cigarettes are nearly identical to those in nicotine gums and patches.
