FDA Variable wattage flashlight with screw-in (510) bulb attachment

I wonder if this would be able to be sold and avoid being deemed as a "tobacco product" by the FDA. Just include a 510 attachment with an LED light and sell it as a flashlight. Maybe even temperature control might be able to slip through -- prevent the LED from overheating.
