    Had it gone the other way, it would have essentially meant it was taken off the market for years until it was actually proven to be safe. So, if you go for the silver-lining, accepting that it is not proven safe and is a tobacco product keeps it on the market.

    They can't regulate it as a drug delivery device. They can still regulate it, or more correctly the juice portion, as a tobacco product.
