    I spoke to one shop over the weekend, their answer to what they are considering as taxable items for the floor tax was all juice and all hardware, to be safe. TO BE SAFE! We do not pay taxes on "ideas" or "intent", this is a joke and amounts to consumer fraud perpetrated by the state!

    Oh I agree wholeheartedly, however I think there may be a premise here. Most laws rely on intent. The intent of this act is to provide a basis for taxing "electronic cigarettes" and I'm going strictly by their words in saying that parts or components are not explicitly identified as taxable...

    So...apply that to a battery. To a mod that is sold without a battery or atomizer. To an atomizer that is sold without any sort of power supply...not one of those items can be defined under the law. Assembled together, yes they can, but separately? The code doesn't mention parts or components.

    And here is the real issue, the FDA regs. The PA thing really is, imo, more like the mob moving in. They see a niche market with great big margins operating on their turf, they want in. The real problems are yet to come, and they begin in just over a week.

    I'm missing the "for profit" part in the regs. I do see where any effort made to evade paying tax is a criminal offense, and where possession of any tobacco product that has not had the tax paid on it is a crime.
