The Supreme Court has not had an e-cig case before them yet. The case referred to was appealed by the FDC at the First Appellate Level in DC which typically hears cases regarding national issues.

However, the First Court of Appeals D.C. (not Supreme Court) did say it could be regarded as a tobacco product due to the nicotine in it. FDA can regulate as such. I would agree with her being clueless.
