About the Possible Ban

I can only post in this forum because I'm a new member, but I just had a couple of questions about the possible ban on e-cigs/eliquid.

I remember when I was younger, I used to import a lot of absinthe from overseas. The importation of absinthe and the sale of absinthe in the country (at the time) was illegal, however the possession of the liquor, wasn't specifically specified by law to be illegal, and therefore, once in the hands of the buyer, could not be confiscated.

I never once had my absinthe seized by customs (which they were supposed to do).

My main question is this: Does the new law prohibit simply the sale and importation of e-cigs and e-liquid, or does it prohibit the possession of said items as well?

As far as I know, the FDA cannot make a drug illegal, it can simply evaluate it (and oddly enough, nicotine and PG have already been evaluated).

If only the government didn't want to lose some of their tobacco tax money... I'm losing my snus (which I've done for years), and I just got shafted with e-cigs right when I started.

Can you specify the law you are refering to? I am not aware of any law passed that targets ecigs or liquid.

The new tobacco restrictions and regs as written have no impact whatsoever on e-cigs. There is merely the "threat" of an e-cig ban lingering around because the FDA has made no rulings or evaluations whatsoever on e-cigs. The agency will likely take some kind of action at some point, but who knows what or when? Right now some importers of e-cig paraphernalia are having some issues getting products through customs and there is a LOT of gray area in the laws--this is largely because there are few if any laws specifically targeting or regulating e-cigs. Of course, there are regs regarding nicotine and smoking cessation devices (FDA fully regulates the latter), but presently e-cigs are NOT considered such devices (largely because they have yet to be evaluated as such). As said, this could change. But as yet, worry about a ban would be premature. Don't sweat it.... (ok, but at the same time I'd stock up a bit on juice, batteries, and attys!)

Oh goodness that's good news. I was getting all worried for no reason I guess because there were a couple seizures or something. Glad I posted it in this sub-forum and not in a non-newbie one.

I'm a noob at all this e-cig stuff too but I've been trying to do as much research as possible over the past week. And you are right--some shipments have been delayed at customs. F/E the NJoy distributors are in fits right now because they appear to have been singled out and their products have been delayed. They are bringing suit against various federal agencies to resolve this, but they are not alone. So basically, there is some concern around, but there is no current ban as such. On the plus side, there are many, many distributors that have stock they want to sell to you!
