as far as i can tell the judgement says stuff that resembles cigarettes or cigarette smoking, falls under the tobacco regulations.

That's how I read it. Just regulated like Tobacco (However the Aussies do that).

I hope they countersue and win though; $9000 is no joke.
Not sure how Supreme Court rulings work "over there". That may have been the final word. Perhaps somebody can clarify.

Once again, WA stands for Western Australia, not the state of Washington.

The 2006 Western Australia law clearly bans the sale of nontobacco products that resemble tobacco products (which has to be one of the stupidist laws I've ever seen).
TOBACCO PRODUCTS CONTROL ACT 2006 - SECT 106

Please note that another Australian law (that applies to all Australian states, provinces, territories or whatever they call them) also bans the sale of all e-cig products containing nicotine.
