Michigan Supreme Court won't accelerate appeal on e-cigarettes

The Michigan Supreme Court said Friday it won't take an expedited appeal from Gov. Gretchen Whitmer in a dispute over flavored e-cigarettes.

The court said any appeal should follow a traditional path to the Court of Appeals.

This is actually a good thing. The lower court effectively said, "Not so fast, you can't bypass normal regulatory procedures with a ban like that!" The governor appealed that directly to the State Supreme Court, which said, "Nope, take it through the normal channels."

Seems a bit like the basketball strategy of slowing down a game. And, in truth versus hysteria, seems like what we need. A wild card may be CDC's Anne Schuchat who's keeping the lung injury investigation open so she can continue digging for dirt. And is spreading CDC money around towards this end. It would be a good thing if there was honesty about relative risk but, given Schuchat recent history, I don't expect this until she is fired.
