Bay and Paypal consider Ecigs as restricted items.. prohibit use of Ecigs

VERY IMPORTANT NOTICE REF PAYPAL .....from a FT forums poster

I have had 4 Claims in with paypal for items NOT RECEIVED all 4 were closed down today as "INTANGIBLE" .. I have rang Paypal & asked WHY this is ..Here is the response I received

As Paypal is owned by E Bay & Ebay class Electronic Cigarettes as "restricted items" you are NOT COVERED by the Paypal 45 day money back policy if the item is "lost" / NOT received / received broken or damaged.


well Hells Bells now here a thing isn't it !!!!! .... Waste of time opening a dispute with Paypal as YOU WON'T WIN IT !!!!!!!!!!!!!!.......

All I can suggest to others who are about to or are currently pursuing claims is DO NOT TELL PAYPAL ITS AN "ELECTRONIC CIG" YOU HAVE PURCHASED .............. Tell em its a flash light .. tell em ANYTHING but DO NOT tell its a "E Cig" ..

Your claim will get Closed down as "intangible" & you get NOTHING .. NO second chance ..NO RE-COURSE to Appeal .. NOTHING................

BEWARE MEMBERS .... This is HUGE NEWS to all who buy E Cigs

You are NOT covered by the Paypal 45 day "guarantee"......

If your vendor informs Pypal that you HAVE purchased E Cigs & equipment .. YOUR SUNK!!!!!!!!!!!!

As an example, this is a quote from a letter posted on ukvapers earlier this year - the policy may have changed in the meantime, but I cannot find any indication of that at the moment. I will do more research on the matter.

If E-cigs are restricted then why are so many available for sale now on eBay along with juice! & the on,y available for, of payment is PP?

Sellers are just risking it, basically. Making a quick buck and moving the money out before they are shut down. Which raises the question of whether you should be dealing with them.

Is this even legal?- e-cigs are just another commodity that is legal in it's use..Paypal can restrict the whole consumer market if they wish?
You can only buy paypal approved products these days? is this anti-trust or something larger? something terribly wrong here... do the regulators tell pay pal to do this?

Paypal is not a bank. Pay Pal is a regulated as a money transmitter according to US law. And they must follow all applicable state and federal laws. It's much easier for them to set a blanket rule so they can do business in all 50 states, rather than having 50 different sets of rules for money transactions.

California already has restrictions, and they're heavily enforced.

Paypal would do well to integrate age verification in their system, but why would they bother?

Paypal in the United States has been "officially" banning electronic cigarettes since shortly after the above actions.

This is all about someone that may have never taken the time to read up or learn anything helpful. Probably never even contacted FT to inquire. Obviously never read the FT thread, never read their Contractual agreement with Ebay or PayPal and is upset because they want it yesterday.(from 1/2 way around the world)

OP, If your Orders are still showing Active, FT has every intention of getting the merchandise to you, or (if Returned by customs) refunding you. Just NOT on your time table.
In case no one told you - China is on Holiday until Oct. 7 so another week can be figured into delays.:D

if a person was selling a starter kit on ebay without juice wouldn't it just be an electronic device? What is carcinogenic about that?

Y'all can keep posing all the rhetorical questions you want but this isn't a Constitutional right. Amazon, PP & EBay are privately owned companies and they can make up their rules regarding what they want to do. Amazon goes out of their way to be very explicit about what they ban under the definition of "electronic cigarette" and it includes very specific device descriptions, right down to liquids, devices of all sorts and parts used in e-cigs. I haven't checked the PP & EBay TOS lately but I have to assume they do the same. They aren't picking nits about "this is ok but that isn't ok."
