The FDA petitioned the Supreme Court to hear this case, but they could really be screwed if SCOTUS rules against them. This case will affect other cases in the pipeline.

You would just kinda think with the Swing that the Supreme Court is on, and with the Chevron Doctrine getting it's Teeth Pulled, that a 6-3 Upholding of 5th CC would be very Possible.

But like Most of the Long Term Watchers have seen, what is Likely or Reasonable (or just Common sense) doesn't always (just about Never) happens.

Something I'm sure a Lot of people are watching though.

Unfortunately, they won't hear this case until this fall, and probably won't announce their decision until this winter. The FDA can do a lot of damage to what's left of the vape industry between now and then,

Yeah... Like you said, even if the SC Upholds the 5th CC, it will be a Long Time before they make that possible ruling. And it is (Already) one of those "Justice Delayed is Justice Denied" things.

I wonder if Brian King at CTP wishes he hadn't taken the job. Because he inherited a Huge Mess from Zeller. And it has gotten Seismically Worse devolving into a Full-Blown Five Horizon Clusterfluck.

A big headache for him has been addressing the results of Reagan-Udall Foundation evaluation.
