A "sure way" to avoid selection in a civic trail is pretty much the same advice. Be opinionated and inflexible. If the lawyers feel you are predisposed to vote one way or the other it is likely you'll get a peremptory challenge. Of course this only works until they have used their quota :)

Sadly my background has caused my removal from the jury selection pool every time I have been called and to be 100% honest I would have been able to give a fair verdict regardless of my background. The lawyers were just scared :p

That didn't work for my ex-wife. She was selected and called up for a civic trial in which a police officer ran a red light and slammed into a van, killing a five-year-old boy (who was properly restrained in a car seat). The police officer was suing the father, who was driving the van, for loss of income because his back had been injured (he was not wearing a belt) and he'd been assigned desk duty. Since he didn't like sitting behind a desk, he quit--and sued for loss of income.

When told the trial was over a traffic accident involving a police officer in which a young boy had died she said "Oh, then I want this one. Put the b@st@rd in jail, cops are always doing sh!+ like that." When informed it was a civic trial and the police officer was the plaintiff, she said "Oh. Fnck him."

Neither lawyer had a problem with her...

I was called to jury duty in April. I asked my doctor for a written exemption. It was granted. I truly cant sit for extended periods of time. Doc agreed. No one wants to give breaks in trials when testimony is being given....FWIW.

yeah the disablilities act is a double edged sword but medical reasons are about the only way to get an exemption. I had a friend that was denied for a hardhip extension, he was the sole operator of a farm during planting season and the judge told him "too bad, hire someone to plant for you." I think that was a little over the top but what are you to do? Hiring a lawyer would have cost more than hiring someone to plant for a couple days.

There was a judge here in Philadelphia that ended up being removed from the bench for abusing his powers over the jury. Apparently some who never responded for jury duty were picked up by the cops and forced to sit in court for a protracted trial (not as a jurist either). And then were called in for jury duty again.......

Actually it might. it depends on how poor your hearing is and the accessibility accommodations of the courthouse. IE ASL interpreters, microphones and amplifiers.

Edit: Mostly the Americans with disabilities act forces them to make accommodations so that you CAN serve on the jury, but if they don't have the ability then you could get an exemption.

Dude. What a mega douche. He ran a red light, killed somebodies child, got his back hurt because he wasn't wearing a seat belt.. then sued them? Screw that. I'd do the jury duty on the day of the trial I would just jump the railing and beat the .... out of that guy.

sounds like she wasn't convincing enough or they ran out of challenges. But yeah there is no 100% sure fire way to get out of jury duty other than to get an exemption. From what I understand it is getting harder to get one of those.

Oh, I am sure she was convincing. With her history and personality I'm sure she was actually being quite restrained, even while spraying spittle and turning red.

As the facts of the case came out, though, I am sure the plaintiff's lawyer knew it was a losing case and really just didn't care...

Yep. But of course she didn't know all that at first. As it came out at the trial (and she relished telling me the facts after it was over), this man ran a red light slammed into the side of the van injuring the driver and two children and killing the third child, then tried to arrest the driver for interfering in a pursuit (or something, can't remember the specific name in that town anymore). When the other six cars showed up at the scene (he'd put in an "officer down" call) he claimed he'd had his lights and siren going, paused at the intersection and proceeded only after determining it was safe--and that's when the van pulled out in front of him "blasting heavy metal music so loud he could hear it over his own siren."

At the trial he had five or six police officers testify as character witnesses, but could not provide any evidence that he was actually responding to a call (or even if there was one out at the time--or whether or not he was actually on duty when it happened). The defendant, on the other hand, had seventeen witnesses willing to testify that the police officer had neither lights nor siren going, that he had been stopped at the light and suddenly pulled out of line and accelerated through the intersection with no warning, and that they could hear no music at all coming from the van. They also testified that he did not seem to be hurt at all at the scene and that he was being belligerent to the defendant even as he was being wheeled on the stretcher to the ambulance. Only four or five actually took the stand--the attorney for the plaintiff asked to forgo the testimony since all of them were saying the same thing and they had the depositions on record.

Half-way through the second week, no one could figure out why there was even a trial, but it went on for a month and a half...

Well, one group of folks got called and left the round up room. Another group got called and were told they were "on break" until 2:30pm. An hour later, the told all of us left to go on home :banana: WOO HOO!
