You may be aware that the FDA recently released its e-cigarette deeming regulations, in which the FDA announced its intention to regulate all electronic cigarettes and liquids as tobacco products. These regulations will very likely mean that the vast majority of e-cigarettes, e-liquids and other vaping accessories that are on the market today will not be legally available to buy after August 10th 2018. After this date, it is very likely that only a small number of closed-system e-cigarettes (e.g. cigalikes) will be available to buy. Manufacturers that do not have FDA approval to sell an e-cigarette or e-liquid after this date will not be legally allowed to continue selling the product, and no new vaping products or e-liquids will be allowed on the market after August 2016 unless the manufacturer applies for and obtains FDA approval to sell that product. The likely impact of these regulations will be the closure of the vast majority of vape shops in the United States after August 2018. To be clear, possession and personal use of e-cigarettes and liquids will still be legal after August 10th 2018, but the sale of any products that have not been approved by the FDA will be illegal.
