I think we will need to stop offering the Free disposable ecig now because our inventory on this disposable is running low, and FDA is stopping shipment again as I was informed by our shipper today!

Yes, we were informed by our shipping company today that FDA is stopping ecig shippment at customs again!

The shipping tracking info says: 01/07/2011 1:13 A.M. Non-customs Government agency hold.

The non-customs government agency is FDA

That's not right. The FDA had lost their appeal (again) back in December. I can't find the documents but in short, FDA cannot currently seize electronic cigarettes or components.

That is also what we believed, but apparently FDA still has authority over tobacco (the appeal classifies ecigs as tobacco) and now they starts to seize shipments again. sigh!

We have to stop offering Free Disposable to our new customers now because of FDA's interception of some shipments for us. The shipping company told us FDA is seizing ecig shipments for all USA vendors now. Can not believe FDA is doing this after the recent court ruling!

That is not correct. The only company that currently enjoys a stay on seizing of shipments is NJoy.

That is what the court case is all about, the FDA was seizing shipments and NJoy sued them.

The judge has issued an injunction to prevent the FDA from seizing NJoy shipments while the case proceeds.
Everyone else is still fair game for now.
