It's still impossible to fathom how anyone (much less a professional jurist) could argue that cigarettes are recreational and e-cigs are medicinal. The irony is, if everything about vapor products was the same, but they didn't help people quit smoking, then there would be no argument for re-classifying them as medicinal products and thus fewer attempts by governments to take them off the open market.
There is still, all across the world, a fundamental misunderstanding of what these products are: recreational products that just so happen to aid in smoking cessation for people who are inclined to use them for that purpose. Glad to see the German court got it right.
