These types of opinions and thoughts are what is going to make getting vaping accepted hard. People who can't figure out that not everything legal is OK on private property are spreading misinformation.

No, it's more like "hot-heads" make everything harder. That is true of them in just about *any* situation.

Generally, people who do not have grown up control over themselves and their emotions cause trouble no matter what they are doing or where they go.

The only issue I have with most modern LEOs is that I know all to well how they are trained, and how they operate. I've never been arrested, or even harassed by a cop for anything (despite the fact that I am a pretty active activist on several issues, including Open Carry).

I worked as a DOJ contractor for 10 years--involved in research, drafting reports, certifications, and training of LEOs--so believe me, I know all about how it REALLY works on the inside of the LE community--especially with regards to the astoundingly treasonous policies being incrementally implemented by the Feds, and the way they trickle that thought process down through the State Police and into local LEAs. This is no conspiracy theory--I worked with them for a decade, writing and publishing the training manuals...




I have no issue explaining a PV and vaping to a citizen. LEOs are a different animal--they are "agents of the state" and these days they serve only two purposes--to collect revenue through the issuance of citations, and to generate income for the State by getting as many people involved in the "criminal justice system" (translation: arresting and imprisoning people) as they can for any reason they think they can convince a jury of.

Since the privatization of our prison system, putting people in jail is no longer seen as means of punishment--it is now viewed by the State as a "revenue stream", AND on a more insidious level, as a way to deprive as many people as possible of their fundamental human rights.

The best thing you can do as a law-abiding citizen is to stay as far away from ALL elements of the criminal justice system--ESPECIALLY talking to LEOs when you are doing something that is perfectly legal and lawful, bu tthey are ignorant about. Because if they get you talking, you WILL eventually say something that will give them the ability to arrest you, or obtain a warrant to search your vehicle or home at a later date.

Th ebest thing to do if approached by an LEO when you are minding your own business is to ..... "Contempt of Cop" is not a legitimate charge, and refusing to chit-chat is NOT a chargeable offense.

And besides, you have the CONSTITUTIONAL RIGHT not to self-incriminate. And since we know that ANY TIME a cop tries to chat you up he is "going fishing", it is ENTIRELY SAFE to assume that "anything you say will be used AGAINST you", even if what you say is totally innocent, admits nothing illegal, and is totally without suspicion.

Name, Address, Date of Birth.

"Am I being Detained?"

"Am I free to go?"

Get on down the road...

Amen, the court system is lined with people mistakingly thinking Leo's are their friends.

The difference with vaping is that it is legal. :) Even if a cop stops you there is nothing they can do as long as you are not violating a no smoking ordinance.
Still doesn't mean I want to sit on the side of the road for 45 minutes for no reason at all...

The only way to fix that problem is to have LEOs trained to recognize e-cigs. If everyone hides it how will that happen?

I have vaped beside cops at stop lights in rush hour traffic to no ill effect. I think that my blatant puffing on my PV shows them that I am not doing anything illegal. Why in the world would I do it openly, next to a cop car at a stop light if it were illegal? Of course, everyone does it differently and I see no issue with that. I just choose to do it loud and proud but with respect.

I can vape in a restaurant or bar if I want to because its not illegal? Oh really? I guess you can't be required to put on a jacket and tie to eat at a restaurant with a dress code then. Right? You are soooo wrong.. and that kind of attitude is exactly what is going to get it made illegal everywhere. Pretty self-defeating.... win the battle and loose the war... cut your nose off to spite yer face... take your pick but one thing is sure: You're gonna be real unpopular among fellow vapers for bringin the man down on them. However, if you're an anti-smoker/vaper and want that to happen, I guess its a plan. Sometimes ya gotta join the enemy to defeat them.

There are devices similar to ego twist style batts that are used for "other stuff" & look exactly like our equipment... They are more prevalently used In California... Known as "trippy sticks".... I saw it online and was amazed lol

OK, this may be true, and there may be a few people stupid enough to use them in public.

But I defy anyone--even an LEO--to show me a SINGLE documented instance of someone actually being arrested and convicted of using such a device for such a reason in public.

Without an established trend of use, the police don't even have "Reasonal Suspicion", let alone "Probable Cause". All they have is heavy-handed thugism based on their own control-freak mentality, and that won't usually stand up in court.

LET them try to arrest me for vaping legally. I'll own their house, their car, and their kid's college funds when they have to pay the settlement of the Federal Civil Rights Violation lawsuit when the dust settles...

See how silly that sounds? That's cause one has nothing to do with the other... just as a smoking ban has nothing to do with Vaping.

Smoking IS banned indoors in CA, in fact in many places it's also banned within 20' of the building.

CW, I think you're misunderstanding my point. In my limited vaping experience most resteraunt owners down here do not want people vaping in their establishment. It is a matter of private property rights. Also, I go to those places to sit down and enjoy a meal. I choose to not vape, not because its "hurr just like smoking", rather I choose to not vape there because I do not wish to be hassled while I'm trying to eat.

Also it is my estimation that it common courtesy to the other patrons that they may not wish to smell whatever I happen to be vaping that day. Mrs. Katz for example doesn't like the room note of the Cowboy juice I happen to like, even though she does like the Papa Smurf juice. However, someone else might be the opposite.

Now if we are talking about my establishment, sure vape away, I don't care. Again it is a matter of two issues here. First, me not wishing to be hassled and vise versa me not hassling others. Second private property rights.

I know of a couple posters here have said that the police cannot remove you from an establishment from vaping, however, they are very much wrong on that matter. They can, and they will. A restaurant is private property and if the owner of the establishment wants you removed you have become a trespasser. Thats just the way things are.

ETA: And for the record while I'm out in the street, I vape openly. And I dare anyone to give me .... about it.

Wow, great thread. Lots of different perspectives here

Let me add mine:

I tend to stealth vape if I'm somewhere smoking isn't allowed. Movies, mall, restaurant, etc. Why? Like some have said, I just don't want to be hassled. I don't chain vape in these places, just enough to get my fix. Everywhere else I vape openly, in the hopes that I will get to educate someone on what I'm doing, how it works, etc.

As far as the cops go, I haven't had a run in with them about it so I can't speak to that, but I do have an idea. Why not set up some kind of educational thing for them? I've noticed that CASAA has been thrown around some in this thread, maybe we could coordinate with local LEO to bring them up to speed on what our devices look like, what they do, what they're for, etc.

Maybe we should be reaching out to them in an effort to increase their awareness of what we're doing (and more importantly NOT doing)

Like most things, I think education is the key to this. The more people we educate, the better off we'll be. That will mean more people vaping, less people smoking, etc

Just my thoughts, worth what you paid for them

I recently got stopped by the local PD while driving; I was casually puffing away on my fakearette/ecig when he walked up to my window. He looked baffled for a minute and asked me what it was, so I explained it to him. He told me he'd been trying to quit smoking for years, plus their new policy was no smoking in patrol cars so it REALLY sucked...I think I converted him! :toast:

BTW he let me go with a warning, even tho I was guilty as hell and deserved that speeding ticket lol. :D

There is one, at least, city in Colorado that passed a law that you can not drive or be in a car with a cigarette if there are children in the car, so you know you will get stopped there.

There are some places that you can not smoke in public places, those places I would not try to vape at either, you are just asking to be questioned. My reason being is that if a smoker saw you getting away with vaping he might think you are actually smoking and he/she would light up.

Writing and publishing training manuals? That's awesome. I don't mean to sidetrack the intent of the thread, but that's pretty cool. Which ones? I might have read them, and it's always cool to meet the person responsible for them.

You know, if I'm in a place with No Smoking signs I just go to the restroom, go into a stall and puff to my heart's delight on my little CleanCig. No one is the wiser while I get my quickie "fix." Although I'm (probably) not breaking any laws, I'd prefer not to flaunt it or push the issue too much...I see this as a huge grey area where things could go sour in our favor rapidly IF public perception/attitude turns against us.

This is a BRILLIANT idea. Maybe local Vaping Clubs could issue formal invitations to their local LEAs, or at least hand-deliver some CASAA literature to their local Chief of Police. Once they know about vaping, they have NO EXCUSE for further harassment, and any harassment after that is CLEARLY a civil rights violation...

I'm not proud of it, bu tI was on the team that published the "Federal Asset Forfeiture Guide" series issued by BJA back in the mid 1990s. That project is, I am certain, one of the things that will probably send me straight to Hell when I die even if I "repent" of my other sins.

I'm working on much more socially-positive things these days to redeem my soul from that crime against humanity...
