Greensmoke not allowed to ship flavored cartridges to CA, OR, WA, or NV?

greensmoke is having a trial offer...menthol only. I entered my zip code and got the following error message:

"Sorry, flavored cartridges can not be shipped to California, Oregon, Washington, and Nevada. Please update your order or change your shipping address."

I contacted customer service and they basically said this law has been in effect for a few years

sorry if this is an old subject but...what?

is it a shipping thing? retail stores here carry flavored cartridges...not just menthol...vanilla, cherry, etc

There are no statewide laws banning the sale of flavors in those states. In California, the Attorney General reached an pre-court settlement with njoy, Smoking Everywhere (which went out of business) and maybe one or two other companies where they "have to guarantee that their products don't contain carcinogens "at a level that poses greater than a 1 in 100,000 risk of excess cancer" and no sales of flavors or advertising "that would appeal to minors" and no sales to minors. But this was NOT passed as state law.

In Orgeon, the Attorney General got Smoking Everywhere and njoy to agree not to sell in the state. Again - NOT a state law that applies to ALL e-cigarette companies, as there are currently many e-cigarette companies/stores located in both of those states. Our research did not find that Greensmoke was involved in either of those lawsuits. However, we have been told that both AGs had been aggressive in sending letters to e-cigarette companies, making them believe they could either be the target of future lawsuits

We are not aware of any such lawsuits or laws banning any company from selling e-cigarettes in Washington and Nevada.

Just as an update or clarification, according to the Oregon DOJ :


The national distributors for both products were served with official Notice that the Attorney General believes their promotion of e-cigs violates the UTPA and they were offered an opportunity to avoid litigation by agreeing not sell e-cigs in Oregon until it is determined whether these products must be approved by FDA.

If electronic cigarettes do not need to be approved by FDA, the companies would be able to resuming selling e-cigs in Oregon so long as they possess evidence to support their promotional claims. Two vendors of electronic cigarettes – TA Travel Centers and Pilot Travel Centers – already signed such agreements.

So it's a very loose, case-by-case situation. NJoy apparently signed an agreement, because they and many other ecigs (Blu, Finiti) are available at just about any convenience store in the state.

I don't know about Greensmoke, but it could be that they aren't willing to go through the beaurocratic mess just to sell when they have unfettered access to other markets.
