As a followup for anyone out there considering ordering from China (Heavens Gifts) I just received notification finally from the FDA. My electronic cigarettes, carts, and 9 bottles of E-juice have not been proven safe by the FDA and my package has been kept in Customs for my protection. What a joke. Anyway, the letter says the package will be shipped back to the sender unless I respond. I can't remember if there is a date to respond by but wanted to give everyone a head's up. This order was placed 2-4 and I think was in Customs by 2-14 at the latest. It has taken them this long to finally get around to notifying me.

OMG How can FDA do that? No one has even passed laws or ruled on anything yet, if I'm correct...Or am I...Does anyone know? Fda can just deam them unsafe & not give you your package?...Or am I wrong? Anyone??

The FDA can deem anything it is not specifically denied by law dangerous to your health and take it away.
They are denied from banning tobacco by the same law that gave them jurisdiction over tobacco.
It seems that since the appeals court overturned the lower courts stay on seizing njoy's shipments that they have been doing more than just the big boy's shipments.
There are other threads about the subject scattered around the forum.
They do not seem to be getting everything, but it is happening here and there.
I hope the OP can get things resolved with the vendor.

I just ordered from heavens gift today, glad it was only a charger and two eGo cones. I'm sure they will make it to me with no problem. Also glad I didn't add that free 10ml liquid to my order.
I think the FDA sucks too! LOL, out $242 but something I also found out while trying to get informatio which I didn't know before, if anything is over $200 then there is an additional import fee... No mention of that in the letter they sent to me.

So I am wondering if it was because of all the E-juice this time that they stopped it. I just placed another order last Sunday - before I got the letter but this time I didn't order any E-juice, just carts and attys and a few chargers. Keep your fingers crossed these come through. I just can't believe the audacity of the FDA. As bad as tobacco is with all the chemicals and crap and lables, etc., you can buy them anywhere and you don't here the FDA screaming to block your right to smoke. Okay, so if it is a child's toy with lead paint or toothpaste from China that is one thing but this? We all know the answer - it boils down to big bucks and the fact that tobacco companies have the $$$. I am still so mad about it!

Hmm... I wasn't aware of this. I had a few order in that range while trying to take advantage of the free shipping offer by some. Did HG replace your order?
I wasn't aware of it either but did some reading on the Customs website - very confusing site but did come across it. Thought it might be useful info for anyone ordering in the future.
I wrote to HG after tracking my package and finding out on USPS site it was in Customs. They were very nice and wrote back with apology but asked that I send the package back. Of course, Customs sent a canned email response so it has just been since yesterday that I received the letter from the FDA.
I am hoping they will refund minus the shipping fee since the FDA has tagged it and it probably wouldn't do any good to try shipping it back. I will just have to wait and see about the order placed on Sunday since it doesn't have E-juice in it.

Why would HG replace his order? They had nothing to do with what happened. Once HG gets the package back they will give him a refund.

Some Chinese vendors I've ordered from guarantee delivery, here's one:
" We have not Customs' problem, and normally, you do not need to pay any customs duty. If your parcel is stopped by Customs or you can not receive it, we would like to re-ship it again, or refund the money to you."
