How does the NY ban on E-Cigs effect us?

I'm not to sure of all of the details involved in the NY Ban on E-Cig's, however I have some questions!

Are NY customers able to purchase E-Cig Hardware & e-liquid from out of state vendors online?

Are NY vendors still able to sell E-Cig Hardware & e-liquid to customers out of state online?

Are you allowed to still use and posses a PV in NY?

If anyone can verify this, please do so, as I'm sure it would help the people from NY (and other states) that are on the ECF here.

I don't think the ban in NY is official yet.

With that being said, I sure hope there will be plenty of loop holes to get around it.

I would hope enough so that NY vapers could continue vaping, along with current NY smokers (Over 18 years old) having the choice to switch to vaping.

I sure would hate to loose the ability to purchase from the good E-Cig & E-liquid vendors that are located in NY!

I skimmed over that bill just to see. I'm not good at reading those things (my brain starts foaming or something LOL) , but it looked like your standard bill that makes it so that e-cigs are sold/bought with the same restrictions as tobacco cigs; certain kinds of signs must be posted about not selling to minors, vendors must not sell to minors, vendors must ask for a valid I.D., etc... I didn't see anything about online sales being effected but, like I said, I just skimmed it.

I am getting emails from Bill Godshall. He is on top of the latest tracks regarding the usage of non tobacco nicotine. This is getting to a worry some state. Many states and even all the Gulf states are banning usage. The Airlines have now banned usage. We are in for a fight or we are losing like landslide. Anyone else following the anti vape news?

Yeah I've been doing some reading on it and I can understand the ban the airlines imposed. I don't agree with any other ban. It's all about the money that the Government, BT, BP, will loose and the money the FDA gets in one way or another to ban them!

Even though its not in my state yet! I follow it because I'm sure once one state passes a ban many states will follow.

I will do what I can to fight it!

New York Next Steps - A1468/S695-2011

Now that the Assembly Health Committee has voted in favor of A1468, the bill will at some point be sent to the Assembly floor for a full Assembly vote. (As of 1/25/11 it was sent to the Codes Committee, but from there it will be sent either to the Health Committee again for any suggested revisions, and then to the floor, or possibly directly to the floor). Section 2 of the bill (starting at line 37) purports to ban all sales of e-cigarettes in New York (unless and until approved by the FDA as a cessation product), while Section 1 only bans sales to minors.


As to how it affects us, if they pass this ban in New York, other states are more likely to follow.

As with Rosa, I dont understand these bills all that well but I too looked at the bill in NY and also found bills in other states ... I cant remember what states and dont want to cause any concerns so ... one thing they state refers to "nicotene delivery devices" not sure if they are aimed at the device or the juice. Seems if the device is delivering 0 nic juice ??? But I'm sure they will STILL want to regulate the devices as well. Sucks because I just got a feeling that once ecigs are "regulated" they will become as ineffective as the gum, the patch, etc .....
