The suit is needed. ATC invoked emergency rules when they published the regulations. Basically sidestepping the required procedures. The security requirements are insane. The law makes individuals who buy from outside the state or make their own juice criminals.

We don't know what is going to come out of the deeming regs from the FDA yet, but we know what the Indiana law will do. The timing for a lawsuit was now. Wait and a judge may believe the complaint has less merit because it wasn't filed when the effects of the regulations where known. We couldn't file earlier because the ATC had not published.

I dislike suing in general, but there was no option for us in the legislative or administrative branches. The judicial branch is where the battle has to move to if it is to continue. We estimate it cost our opponents 5 mil to get the law passed. We don't have that kind of money to move the legislative branch. The lawsuit is expensive, very, but it's much less than 5 mil. The Indiana constitution does not allow a group of people to be subject to laws that don't apply to all Hoosiers. The lawsuit points out how that tenant of the constitution, and others, are violated by the new law.

Freedom isn't free. At least we do not have to pay with our lives or blood, just money.

Full consumer membership costs $100 and every dime goes to fighting for vapers. Hoosiervapers.com/shop. (I'd link, but it's hit or miss on my phone lately and may disturb some section of ECF rules I'm not familiar with.). Full members can vote for board members and there are shops that offer discounts to card carrying members. Yep, it comes with a card too....

I'm a member. I'm on the board. I'm on the executive committee. I've been fighting for years. The fight has evolved. I welcome everyone to join me. After all I'm not special, just a vaper trying to do what is right.

The website isn't working properly, I clicked on the facebook link to get to the website, after donating the site doesn't take you back to the home page. Tried to click on the membership page....nada.

All the consumer members who showed interest in pitching in, but were unable to come up with funds, that I know of, have already been sponsored by another member.

Vaper Bank sponsored a bunch. Other shops did also. A few consumer members did as well. Vendor dues are 1k per location and many have gone above and beyond.

Most goes towards the lawsuit. Some goes to lobbying efforts. A tiny bit goes to printing stuff for lobbying. The board hates spending money unless we know it will be effective. We argued about one printer expense for nearly an hour until the proposal was withdrawn. That was for less than a hundred. You don't even want to know the length of discussion about hiring an attorney....

I've looked at the website numerous times and could never find the 'Shop' page that Kent was so gracious to provide for us. Now I'm a proud member. I wish there were a banner I could add to my signature or something to show my affiliation.

As of now, only Hoosier Vapers board members can view the filing...

I doubt it will be released to the general public until after it progresses a bit and certainly after a judge is assigned to the case.
But it's already a matter of public record. Anybody can look at a filed petition.

It's a matter of public record so lacking an account to view it online with other legal records, a trip to the state court house and a small copy fee, anyone can access it. Posted on the web by the Hoosier Vapers hasn't happened yet for people outside the board and isn't something me, or other, board members are making a priority right now. We intend to do so, but we are more concerned with the judge assignment and assembly reaction at this moment. We'll be holding elections fairly soon so you are welcome to run and bring these kinds of things up. New blood and effort is always welcome plus ideas on how to better serve the vapers in Indiana are always a great thing.

As to the emergency rule, I have access to a document through my board account that is copy of the emergency rule. I have not been able to find it in in.gov yet, but that site tends to lag a month or so with getting that kind of thing posted.

We had copies of the filing draft and the ATC's emergency ruling at the last meet up at Beech Grove last weekend. That was my first chance to see the lawsuit in all it's leagalize. I had already read the ATC document so I didn't bother with that last Saturday. You never know who or what is going to be at the Silver Bullet on the third Saturday...a couple of the co-plaintiffs were there as well.

When you land at Products | Hoosier Vapers click on the "$ Donate" tab. Click on the $1 icon which will allow you to increase the amount and also give you a 'view cart' link. I had to sign up.
I followed your link but did not have to sign up to donate.
