    Why haven't they filed a lawsuit in an area where vaping is treated as smoking? A legal decision in favor of vaping would advance the cause far more than whatever else they seem to be doing. A well-publicised legal case and favorable decision in a court is what is needed, not just collecting donations and taking testimonials.

    who will fund it ? it takes deep pockets and for that sort of litigation.. its been open season on smoking for yrs until you change the mindset about smoking then vaping is always going to be treated as smoking and I don't see smoking ever coming back

    Don't they collect donations? Don't they have attorneys on their staff? Can't they start a special fund drive to get enough money for a lawsuit? Short of a well publicized lawsuit, nothing else really will really make a difference. It would be well publicized, considering it would be the first such case of its kind. Maybe they are just scared of a loss.

    This is true. Such a lawsuit would have to be filed in the state where the prohibitive legislation or ordinance was passed. A federal District Court would have no jurisdiction unless the matter affected interstate commerce, equal protection or some other cause enshrined in the Constitution.

    Unless there are damages to be recovered, most competent trial lawyers wouldn't take the case on a contingency basis and pro bono work is hard to come by.

    Yes, they do collect donations. However, good attorneys are expensive. A competent trial lawyer would eat CASAA's entire annual budget inside of a month if an effective cause of action were to be researched, drafted and filed. Then, there are hearings. Depositions. More hearings. Filings. The trial itself. You're talking about hundreds of man-hours at $200.00 per hour.

    CASAA's 990 form is easily available for public review. The budget ain't there yet.

    They might find a committed activist who is a bar member and willing to work pro bono, but those guys/gals are extraordinarily hard to find.
