Hello I am a corrections officer and need some help Fighting a ban on e-cigarettes from the MO deparment of corrections. I had been using my e-cig for about one year before the ban. The department sent out a memorandum that forced us to end use of the e-cigs. I now smoke tobacco cigs inside the instatution and use my e-cig at home. I have only been drug tested once while using my e-cig and was clean. What I am hoping is some one here is a smooth talker who can put the correct words in order for me. I am also planing on sending some of the pro e-cig stuff found here at the ecf to them along with this, in hopes it will change there minds. Thanks to anyone who can help.

As you may recall, during a previous DIA Executive Staff's meeting, a brief discussion ensued about whether to permit electronic cigarettes (e-cigarettes) inside the instatutions. The purpose of this memorandum is to inform you that niether employees nor offenders will be permitted to possess e-cigarettes inside the institution at this time.

After additional review of the issue, it was discovered that the American Medical Association (AMA) has recommended that e-cigarettes be classified as "drug delivery devices", which requires FDA approval. The AMA has officially recommended that state legislatures should prohibit the sale of e-cigarettes since they are not FDA approved. E-cigarettes are currently not approved by the FDA and have been banned in six other countries.

The FDA reports that e-cigarettes contain Diethylene Glycol, a chemical used in antifreeze that is toxic to humans. Additional medical research indicates users can get "high" from three different varieties of e-cigarettes that contain ingredients taken from potent sativa and indica strains of ......... There is also potential for abuse as users can fill the replacement cartridges themselves and can add ......... or other illegal substances to the device. At this time, it is my decision to ban e-cigarettes from our institutions.

Please take appropriate action to ensure that e-cigarettes are not allowed into your respective institution. If you have any questions, please feel free to conact my office or your Deputy Division Director. Thank you.

There is nothing "untrue" in the satements in the memo, but he certainly is missing a lot of the facts. He is probably operating on a set of facts that look like this: http://www.madisoncountyhealthdept....cigarettes and Secondhand Smoke EH 112110.pdf

He appears to be ignorant of the fact that e-cigarettes are intended to be a reduced-harm alternative to smoking, not a treatment for nicotine addiction. If they claim to be the second, then the AMA is correct, they need FDA approval as a drug. The US District Court for the District of Columbia has advised the FDA that, if companies make no health claims about their products. the FDA can only regulate the products under the Family Smoking Prevention and Tobacco Control Act.

The only reason the E-cigarettes have been banned in six other countries is those countries believed the FDA's propaganda about their test results, rather than examining the FDA's acutal lab report and drawing thier own conclusions.

CASAA has prepared a more complete and informative version, that references research atually conducted on the products and consumers, rather than unsubstantiated opinions or misapplied research. Rsearch conducted on cigarette smoke proves nothing about vapor. If they want to know the contents or properties of vapor, then they need to study vapor, not smoke.
