MOH bans e-cigarettes, other emerging tobacco products

Exactly my thoughts. But they did mention it is the first phase of the ban. I'm just a little bit confused about the ambiguity of the terms, does it mean that liquids not containing any nicotine in them are legal? Sounds like there are quite a few grey areas.
Yeahhh... I'm so confused... so is it for liq w nicotine or also for those with no nicotine?? Some more how come cna website put pic of several pvs if it's not a ban on pvs... jialat la. Super unclear !

It's so scary to bring my pv out now even when I only use it at secluded areas. Can vape at home now. Everyday look forward to go hm n vape. Haizzzzzzzzzz

Don't use politics lah haha. Even if WP Or whatever party they will still ban vape just to earn money. ESPECIALLY if it's WP. End of the day, it's the mindset of the Singapore's leadership as a whole.

yeah no political party going to fight for us...unless IPV or Cutt Wood make their own party here

I dunno seems to me it's like they are reserving a spot for big tobacco to be able to sell their e-cigs...

You know... Since the cartridges will contain only a 'controlled' amount of nicotine.... And well you know.... BAT just released a study saying vaping IS safer than smoking...

Just throwing it out there....

Amendment of Schedule
2. The Schedule to the Tobacco (Control of Advertisements and Sale) (Prohibited Tobacco Products) Regulations 2014 (G.N. No. S 769/2014) is amended by inserting, immediately after item 1, the following items:

2.
Smokeless cigar, smokeless cigarillo or smokeless cigarette, or any other tobacco product intended, or labelled or described as suitable, for use like a smoked tobacco product, but where no combustion takes place and no smoke is produced
Section 15(1)(b)
3.
Dissolvable tobacco or nicotine that is intended to dissolve on the tongue or in the mouth, whether or not in the form of a strip, stick, tablet or an orb, and includes tobacco or nicotine candy, pellets, tablets, pills and lozenges

4.
Any product containing nicotine or tobacco that is intended, or labelled or described as suitable, for application on or into any part of the body, whether intravenously, by implant or by topical application as a gel, cream, patch, paste, powder, spray or an aerosol, and includes any toothpaste or tooth powder containing nicotine or tobacco

Prohibition on importation, distribution and sale of harmful tobacco products
15.
—(1) Notwithstanding anything in this Act but subject to subsection (3), no person shall import, distribute, sell or offer for sale —
(a)
any chewing tobacco;
(b)
such other tobacco product, or class of tobacco products, intended, labelled or described as suitable for use other than smoking, as the Minister may by regulations prescribe;
(c)
such tobacco product, or class of tobacco products, as the Minister may by regulations prescribe, where the Minister is of the opinion that such product or class of products has or is capable of having the effect of encouraging or otherwise promoting smoking or other uses of tobacco products; or
(d)
such tobacco product, or class of tobacco products, as the Minister may by regulations prescribe, where the Minister is of the opinion that such product or class of products has or is capable of having, directly or indirectly, an adverse effect on the health of the public or any section of the public.

(2) Subject to subsection (3), no person shall import, distribute, sell or offer for sale such tobacco product or class of tobacco products as the Minister may by regulations prescribe, being tobacco product —
(a)
that contains; or
(b)
the emissions of which contain,
any substance in excess of such maximum amounts as may be prescribed for that substance.

(3) Subsections (1) and (2) shall not apply to the import of tobacco products into Singapore solely for the purpose of taking them out of Singapore, whether on the same conveyance on which they were brought into Singapore or on another conveyance and whether or not they are landed and kept in any place in Singapore pending their being taken out of Singapore.

(4) For the purposes of subsection (2), the Minister may prescribe different maximum amounts for different substances, in relation to different classes or descriptions of tobacco products.

(5) Any person who contravenes subsection (1) or (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both and, in the case of a second or subsequent conviction, to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 12 months or to both.

(6) In subsection (1), “smoking” means inhaling and expelling the smoke produced from the combustion of any tobacco product or any part of such tobacco product.

"where the Minister is of the opinion that such product or class of products has or is capable of having the effect of encouraging or otherwise promoting smoking or other uses of tobacco product. You can argue until the cow comes home but at the end of the day, the government will just throw you one sentence. "It encourages youth to take up smoking" Although it is false, you will lose. Individual resources vs government)

For those of you (especially newer members) who think that e-cigs/vaping will only be illegal after today, you are gravely mistaken.

There is no grey area regarding if it's only for nicotine/liquids or are PVs included. It is clear cut; vaporizers were banned a long time ago.

Section 16 of the Tobacco (Control of Advertisement and Sales) Act prohibits the import, distribution, sale or offer for sale of any article that is designed to resemble a tobacco product; this includes vaporisers such as e-cigarettes, e-pipes, e-cigars and the likes.

Any person who is convicted of an offence under section 16 is liable to a fine not exceeding $5,000 for a first offence and a fine not exceeding $10,000 for a second or subsequent offence and any e-cigarettes imported will be seized and confiscated.

My sentiments exactly... i see these media coverage more of a deterrence alarm for hipsters and underage kids then anything else.

Making it illegal only makes the black market more profitable and the counter effect of it all.. you cant even regulate .... if some choose to do silly things with PVs

Grey area/ ambiguous.. they will CONDEMN u with the law no matter what.. jus dun get caught with any PVs and e-liq

My take on this is.. cut the underage kids and hipsters away from our secret vape society and all other means of vaping and vape products and device, this matter should not be as hot as it is now.

Pretty sure all the vapor wannabe vaping openly and making sure the government attention is on us. I have never heard of vaping a few years back but with the advent of subox starter kit..... sigh

To be honest, I'm quite happy about this law. Smash the hipster and kids. They are the worse lot of the bunch man. And I'm a kid myself but I'm slamming these people who like to seek attention with their "Hey look, I'm a vaper" act

Edit: When I say I'm a kid, I meant to say that I'm of legal age of 18 and above.

Crazy, you said it correctly , CONFUSION, its a tactic that has been used for centuries...confusion=fear and the more vague they are the more confused you are and more fear........I'm from the US but were not too far behind you( if Clinton gets in we may get there all the sooner ) We were founded as Nation of Individualism , where the function of Government was to protect our rights given by god, not man......what god gives man cant take away, what man gives ,man takes back.........we've been lulled into a Nanny State........its much bigger than ecigs , the dilemma we face in vaping is merely a symptom of a bigger problem.....

Not that I want to play with the law, but it is also quite clear that Section 16 refers to the import/distribution/sale/offer for sale of e-cigarettes and its counterparts. This effectively does not cover possession as constituent to an offence. The point is that only if they have reason to believe/suspect you are intending to distribute/sell said products (i.e. carrying around 10 bottles in your bags), would you be convicted of the offence.

Could any member figure out if any part of the Tobacco Act specifically talks about possession being an offence? I'm actually pretty sure it was supposed to come into effect today.

Item 5 is found under Section 15(1)

15.

—(1) Notwithstanding anything in this Act but subject to subsection (3), no person shall import, distribute, sell or offer for sale —

which means there should be no import/distribution/sale of related products. No mention of possession. Same with the insertion of Item 5, which does mention vaporiser, but does not mention the consequences of possession.


Technicalities aside, just vape safe at home and privately, don't even get your neighbours to see you, that's the way we should all stay hidden. There's one article that says "You can't catch us all" in reference to e-cigarette owners; it will only hold true if we don't do it publicly and stupidly.
