Section 16 of the tobacco (Control of Advertisement and Sales) Act prohibits the import, distribution, sale or offer for sale of any article that is designed to resemble a tobacco product; this includes vaporisers such as e-cigarettes, e-pipes, e-cigars and the likes.

Precisely this.... So if I'm not importing or selling?

Indeed.

We need protection from the 'protectors'.

I am old enough, potty-trained and housebroken. I can handle eating utensils without harming myself. So, I can do just fine without busybodies climbing all over me.
Seems the busybodies can't do without me, though. Well, dogs got fleas, societies got politicians...

My guess is, they will still tangkap you lah. But with the current amendments to the Tobacco Act, you will have a case to fight AS LONG as you don't have any history (that can be found) of sale/import/distribution.

Won't have any case one lah. You want to spend so much money on lawyer meh? And let's stop talking about this. Stop giving them the idea man ahhahaa

End of the day, Don't be a attention seeker wannabe vaper walking around and blowing huge cloud. The law has to be implemented because of the attention we are getting. You can see the difference between vaper of the past and now. It has become so hot that everyone know what is vape. A few years back when I was a teenager, I didn't even know vape existed.

And please, don't be condescending just because you have been here since...... last year..... 8l

Nobody is promoting abusing of loopholes, that obviously are there, this is due to 2 separate ministries dealing out separate bans... It's present in many of our local regulations....

Don't go fear mongering and add on your personal assumptions onto what has been stated in black and white

If it's meant to be written down, trust me it will be written down.....

Again I'm not advocating for anyone to play with loopholes or grey areas. But still don't talk like there are no loopholes or grey areas currently.

I deal with such situations in differing industry for my bread and butter and like i mentioned, they left a loophole... On purpose... Why? Nobody knows....

My advice.... You want to play, get a good lawyer... But if you import/distribute, then no chance, it's clearly stated....

Just pointing out the facts, sounded like some had the wrong interpretation of the amendment of schedule. Certainly not my intention to speculate or promote any circumventing of the law.

But yeah ultimately it is up to the individual. I for one wouldn't advocate playing with the grey areas.

Let's just agree to disagree and leave it as that?

Anyway, Let's leave the discussion at it is and leave it. No point discussing about this so openly and giving people (both the government and clueless people) ideas. On one hand, such speculation will make the government smarter and implement tougher laws. On another hand, it will make clueless people think this is okay, that is okay and then when they start getting shat up their ...., they complain. We can discuss our feelings about this new law but from this point on, please don't start to speculate any more. The law will be as it is. Up to you to play your own game.

In lieu of the recent law, These are the following advices I can give.

1. STRICTLY follow the local forum rules & regulation. This mean NO asking of source or location. Do not give any location even if it's just in jest/for the LOL

Please read this thread before going to any other thread Newbies Q&A Thread. [PLEASE READ BEFORE POSTING IN THIS FORUM]

2. People of this sub forum do not have any electronic nicotine delivery system or vaporiser. Picture found here are all from online source.

3. Vaping in public will ensure that your gear will be confiscated. There will be no "give chance" about it. Public mean your VEHICLES as well. As long as other people can see you, that's public.

4. DO NOT speculate on the law. Don't give any ideas. Do not fear monger. The law is as it is.

5. This is the punishment for import, distribution and sales. "Any person who contravenes subsection (1) or (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both and, in the case of a second or subsequent conviction, to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 12 months or to both."

6. If you are still stubborn and you get caught. Don't complain to us. That's your own fault.

7. Most of us are from army, we all know the most important core value. Practice it.

Edit: Just a add on I found online (even home is considered public if people can see you)

You may be in your own home, but that does not mean you can swan around naked. Yes, it is illegal to be naked in your own home - but with a caveat. Under Section 27A of the Miscellaneous Offences (Public Order and Nuisance) Act, Chapter 184, a person cannot be naked in a private place while being exposed to public view. This law came into effect in Feb 27, 1996.

If you are found guilty of this offence, you risk having to pay a fine not exceeding $2,000 or being sentenced to prison for a term not exceeding three months - or both.

Furthermore, if you are committing this offence, a police officer has the right to enter your home without your authorisation and use force, if necessary, to arrest you. (for the being naked at home case)

In August 2009, taxi driver Chua Hock Hin (right), was fined $2,600 for being naked in his own flat in clear view of his neighbours.

The next time you plan on walking around in your birthday suit at home, it might be a good idea to draw the curtains first.

In this case, imagine if you vaping. And all these is just for illustration purpose only. If neighbour saw you vaping at home and complain to /call the police. The police have the right to enter your home without your authorisation and use force, if necessary to arrest you.

John my friend... they dont give a sh*t about your problem.. they only see what is beneficial to them... till the day they can see that vaping has sustaniable gain to them you can only help yourself

Welcome to the real world my friend;)
Let's just discuss cigarettes for now .. I used to do like 2 packs Marlboro menthol a day, what bout you guys? :)
